Research On Government Supervision Of Private Pension Institutions In China

In recent years,with the increasing proportion of China's elderly population,China's population aging process has accelerated significantly.According to the data of the National Bureau of Statistics,China has officially entered the ranks of aging countries in 1999,becoming the country with the largest number of elderly population in the world.The problem of providing for the aged is becoming more and more prominent and has become one of the major social problems that need to be solved urgently.With the guidance of national policies,China's social resources have gradually poured into the field of old-age care services,with the emergence of legal persons such as private individuals or social organizations providing old-age care services for the elderly population.On the one hand,this kind of market-oriented service organization for the aged can meet the growing demand for the aged in our country to a large extent.On the other hand,although market-oriented pension institutions can promote the continuous improvement of social pension services in our country,a series of problems easily exist due to their market-oriented operational characteristics.Therefore,the regulation of social pension service institutions needs not only to clarify the diversification of social pension services through legislation and give scientific and standardized legislative management from a macro perspective,but also to strengthen the legal supervision of pension institutions,especially private pension institutions,improve and promulgate relevant laws and regulations,and form a government-led legal supervision system.The article is mainly divided into four parts to introduce and elaborate the relevant concepts and current situation of government supervision of private pension institutions in China,analyze the existing problems and put forward relevant suggestions for improvement.First of all,the article introduces the definition of private pension institutions,distinguishes between private pension institutions and private pension institutions,expounds the meaning of government supervision,and puts forward the necessity of government supervision of private pension institutions.Then,it puts forward the necessary theoretical basis for the study of government supervision of private pension institutions,and clarifies the necessity and necessity of government supervision of private pension institutions and related theoretical theories.Secondly,the author analyzes the current situation of government supervision of private pension institutions in our country,studies and analyzes the relevant provisions in laws and regulations step by step,and puts forward the existing problems of private pension institutions from the aspect of law implementation,such as: scattered relevant laws,blocked operability,unclear main body of government supervision,lack of perfect government supervision mechanism,resulting in problems of no management or overlapping management,imperfect evaluation system and information disclosure systemFinally,the article has gained some enlightenment through the experience of government supervision of foreign private pension institutions and combined with the actual situation in our country to give relevant suggestions for improvement of the above-mentioned problems.
