Study On Legal Problem Of Administrative Treating Power In Abrupt Environmental Accidents

China is a country where environmental emergencies occur frequently.In recent years,with the rapid development of urban construction,environmental emergencies are increasing in China,which have brought adverse effects on public safety,public interests and social production and life.The response to environmental emergencies is an important test for the administrative subject and also related to the credibility of the government.Administrative emergency power plays an important role in response to environmental emergencies.The exercise of administrative emergency power can greatly improve the efficiency of response to environmental emergencies,can restore production and life in the shortest time,and has important significance for maintaining social order.But at the same time,we should also see.that the administrative emergency power is a special power,which has a high degree of power concentration and greater discretion.If the exercise of administrative emergency power can not be effectively standardized,it is easy to cause the abuse of administrative subject power,which may infringe on the public interest and the legitimate rights of citizens.At present,China has accumulated a lot of experience.in response to environmental emergencies.With the introduction of relevant laws and regulations,the exercise of power in response to environmental emergencies has also been standardized.However,the research of "administrative emergency power" in our country is not very in-depth,the relevant emergency legal system is not perfect,and the exercise of administrative emergency power still needs to be standardized.On the basis of the current research in China,according to the characteristics of environmental emergencies,this paper discusses the concept definition,right attribute of administrative emergency power,analyzes and discusses the relevant experience of foreign countries,In the three aspects of the legal system of the administrative emergency power,the exercise of the administrative emergency power and the supervision of the administrative emergency power,some suggestions are put forward.
