In recent years,with the development of China's urbanization process,illegal water intake and illegal sand mining and other water crimes and crimes have occurred frequently.This not only poses a huge threat to public safety and public health,but also has a serious impact on the sustainable development of the economy.The connection between water conservancy law enforcement and public security law enforcement is the focus of effectively combating water crimes and crimes,and is also an important link in the connection between administrative law enforcement and criminal justice in the field of water conservancy.However,there are many practical problems in the current connection between water conservancy law enforcement and public security law enforcement,and the phenomenon of "not moving a case,difficult to move a case,and replacing punishment with punishment" is common.When a water violation is suspected of being a criminal offense,the water conservancy department often chooses not to transfer the case to the public security organ,but merely imposes administrative punishment due to reasons such as unclear operation guidelines,difficulties in evidence collection and preservation.Even if the water conservancy department transfers the relevant case to the public security organ,the public security organ often refuses to file for investigation due to the lack of criminal legislation on water crime and insufficient evidence.This phenomenon of "substituting punishment for punishment" not only causes the relevant responsible person to evade criminal responsibility,but also is not enough to have a strong deterrent effect on other water violations and criminal acts,which causes a fluke mentality of the person who commits water violations and causes bad The social atmosphere of China is not conducive to safeguarding the fairness and justice of society and the legitimate rights and interests of the people.At present,most of the existing researches on the connection between administrative law enforcement and criminal justice in China are mainly in the fields of safety in production,traffic accidents,food and drug safety,and most of them focus on theoretical research on the overall work of the connection between administrative law enforcement and criminal justice.There are few special practice studies on the link between water conservancy law enforcement and public security law enforcement.Therefore,this article takes the connection between water conservancy law enforcement and public security law enforcement as the key research object,conducts field research on City A,and conducts research and analysis in conjunction with relevant practical cases,with a view to playing a positive role in promoting the development of the connection between water conservancy law enforcement and public security law enforcement.This article first introduces the meaning of the connection between water law enforcement and public security law enforcement and the relationship between administrative violations and criminal offenses,combined with the analysis of the functional positioning of state organs in it,and theoretically summarizes the work of water conservancy law enforcement and public security law enforcement.Provide a theoretical basis for the following.Secondly,taking the city of Henan Province as the field research object,the current situation of the connection between water law enforcement and public security law enforcement in City A is introduced,and a detailed analysis is carried out in conjunction with the typical cases of city A suspected of water crime.Afterwards,based on the practical investigation of city A,the main problems in the connection between water law enforcement and public security law enforcement in city A were found,and the specific reasons were thoroughly analyzed.Finally,in order to solve the dilemma faced in the connection between water conservancy law enforcement and public security law enforcement,I propose the author's suggestions to the problems found in the above research.
