Research On The Combination Of "Three Governance" And Folk Belief From The Perspective Of Rule Of Law

China's rural folk belief has a long history,which has played a role of regulating and guaranteeing similar to law and maintained the harmony and stability of China's rural society.After more than 40 years of reform and opening up,China has embarked on the development path of learning from the western model of rule of law.Party's 19 in 2017 put forward "improve the autonomy and the rule of law,combining rural governance system of rule of virtue"(hereinafter referred to as "three combination" cure),to increase the "three combination" cure for new governance strategy,as a basic strategy for rural governance problems during the period of transition,this is China's rural folk religion provides the rule of law in the survival and development of new soil.Rural area is an important field of national governance,and the excavation and optimization of multiple norms is the key to ensure the complete operation of the "three governance combined" governance system.From the perspective of governance norms,this paper makes an organic connection between Chinese rural folk beliefs and the "combination of three governance" governance system,integrates folk beliefs into the modern "combination of three governance" governance system,and provides traditional normative resources for the "combination of three governance" governance system.In addition to the introduction,the main body of the article is divided into three parts:In the first part,the concept and connotation of folk belief are deeply interpreted,and it is strictly distinguished from customs,feudal superstitions,institutional religions and legal beliefs.Secondly,it demonstrates the concept,the process and the connotation of the rule of law of "the combination of three governance".It points out emphatically that "the combination of three governance" is not only a rural governance model,governance system and governance mechanism,but also a rule of law strategy in line with China's local conditions in the context of the rule of law of socialism with Chinese characteristics.In the end,the internal logical mechanism of folk belief and "combination of three governance" is sorted out,and it is pointed out that folk belief is a normative resource of "combination of three governance" in rural areas,which can be used to promote the smooth operation of "combination of three governance",and "combination of three governance" should be recognized and accepted.The second part demonstrates the function of self-government and rule of law contained in folk belief in the perspective of rule of law.The function of autonomy contained in folk belief is mainly reflected in three aspects: first,it lays a social foundation for the effective realization of villagers' autonomy;second,it provides resources for the governance subject of villagers' autonomy;third,it provides normative resources for villagers' autonomy;The function of rule of law contained in folk belief is mainly reflected in the function of social integration governance,social control and dispute resolution.Folk belief is the inner spiritual power of the rule of virtue,contains good moral factors,has moral strength and behavior binding force,and is the embodiment of the function of the rule of virtue of folk belief.The third part demonstrates the legalization of folk belief in the field of "combination of three governance".This paper discusses the necessity,basic principle and path choice of the rule of law of folk belief.It is pointed out that the publicity of folk belief is the legitimate basis of the rule of law,the legal system of folk belief is not perfect,and the problems of folk belief exist.We should adhere to the party's leadership,take the socialist core values as the guidance,inherit the essence of traditional culture principle;We should establish our contemporary legal belief with the help of folk belief,promote the rule of law of folk belief with the combination of private nature and public nature,and improve the legal system of folk belief.
