At present,the pace of judicial reform has entered a deepening stage,and various judicial systems have carried out corresponding reforms according to their own actual conditions.As part of the judicial system,the court has implemented reform of the classification management system of court personnel on the way to achieve the goals of judicial reform.The power structure of the People's Court of China is dual in nature.Professional judicial power and administrative management power are parallel.Sometimes conflicts occur in the actual operation process,which affects the normal exercise of judicial activities.However,the main work of the court is trial,and other work should be Focus on it.Morris Rosenberg said in "Quality of Justice" : "Judicial is a collection of people and institutions.Even with the clearest rules,the most transparent procedures,and the most sophisticated court technology,judges are still the most critical factors." His sentence pointed out: Judicial management is the management of people and their behavior.The implementation of personnel classification management reform is to divide the personnel according to the two powers running inside the court.The personnel with judicial power are classified as judges,and the other personnel are divided into judicial assistants and judicial administrative personnel.Different methods are used to manage different people.,Trying to break the confusion between administrative management power and judicial trial power with this differentiated management method,to truly liberate judicial trial power,so that it has distinctive characteristics of independence and autonomy in the court,and highlight the leading position of trial.It has laid a foundation for the judges to effectively exercise their judicial power and laid the groundwork for the realization of judicial justice.Many scholars at home and abroad have studied and explored the reform of the classification management of court personnel from different angles and in different ways,and put forward a number of good suggestions,opinions and specificimplementation measures.This article takes the county court of L County as a case,and uses the perspective of new public management to conduct in-depth research on the classification management reform of court personnel,and then proposes corresponding solutions and measures.This thesis is mainly composed of four parts.The first part is a brief explanation and overview of the concepts and basic theories related to the classification management reform of court personnel.The second part introduces the situation before and after the implementation of personnel classification management reform in the county courts of L County and the steps of the reform plan.The comparison of the situation before and after highlights the impact of personnel classification management on court management.The third part is based on the disadvantages of the county courts after the reform,and discusses the reasons for the disadvantages of the grassroots courts.The fourth part is based on the reasons analyzed in the third part,and puts forward countermeasures and suggestions on the problems arising from the reform of the classification management of the grassroots courts.Based on a review of the current status and existing problems of the classification management reform of the county court personnel,this thesis refers to other domestic courts' specific implementation plans for such reforms and presents some of the reforms in the county courts from the perspective of new public management.Through in-depth analysis of the problem,after analysis and comparison,it is understood that under the current department's improvement process,the disadvantages arising from the reform of classification management of court personnel across the country are more prominent and prominent,and some have even affected the realization of judicial fairness and judicial efficiency.After analysis and comparison,the problems in the court's implementation of personnel classification management reforms were sorted out,including: the related supporting systems are difficult to implement,and new measures have not been taken to respond to them in a timely manner.The resettlement of personnel was not timely and properly arranged.In addition,local courts at all levels are affected by the financial constraints of local governments and the evaluation of trial quality and effectiveness.They have overly pursued performance evaluation indicators such as the case settlement rate,the rate of revocation,the online rate of adjudication documents,and the rate of interest judgments.It has increased the difficulty and complexity of personnel classification.The reform of the classification management of court personnel has not made relevant provisions for the personnel dispatch system.The comprehensiveness of personnel classification management needs to be strengthened.In this regard,this paper proposes to speed up the de-administration of the judge system to provide strong support for post judges to independently exercise their judicial power;to implement and improve the professional security system of judges as soon as possible to enhance the professional status and identity of judges;and to establish post judge dynamics Management and exit mechanism,making the personnel classification management system a dynamic management system that can enter and exit;formulate a scientific and reasonable judicial performance evaluation mechanism to enhance its practicality;strengthen the judicial administrative management of the courts,so that the court administrative management is orderly and smooth.
