Houses with limited property rights,is corresponding to the real estate registration.It refers to a house of this kind:Use the land owned by rural collective economic organizations for real estate development;or it may be built independently by the township(town)government or the village committee that owns the land;or jointly construct with the real estate developer.After the completion of the real estate,it is impossible to register the real estate;and instead with the township(town)government or village committee signed the "purchase agreement" or by the township(town)government,village committee issued the "house ownership certificate".Houses with limited property rights,or in the construction process,or in the sales process in violation of the relevant laws and regulations,resulting in this kind of real estate buyers ultimately unable to carry out real estate registration and obtain the legal sense of real estate ownership proof.People's court is in processing "houses with limited property rights" when buying and selling dispute,it usually concludes the case by confirming the invalidity of the contract of sale of house.However,because of its price advantage,"houses with limited property rights" has a wide market,and in the process of the supervision of the state's repeated orders and prohibitions,it is still repeated and spread which has become a problem that cannot be avoided and should not be avoided by legislation and justice,and should be solved as soon as possible.Under the current system background,on the basis of stock statistics and scientific classification of "houses with limited property rights",we should associate the problem with "free transfer of collective land use right".
