The judicial system includes the court system,which has long been regarded as the last line of defense for social fairness and justice.As a country ruled by law,there exists a group of judges who hold judicial power in the whole legal system,that is,the group of judges who exercise the functions of settling disputes and protecting legal interests on behalf of the country.Because of China's national conditions,court personnel still adopt the management mode of ordinary government organs,which does not match the professionalism and particularity required by judicial departments.It does not reflect the requirements of judicial organs in case adjudication and affects the process of legalization in China.In 2004,the first round of judicial system reform was carried out,which clarified the establishment of judicial departments and their responsibilities.In 2008,the second round of judicial system reform was carried out,aiming at strengthening the construction of judicial ranks and related professional security.In 2013,the third round of judicial reform was launched.The central government strengthened the top-level design and innovated the management of judicial ranks.In practice,we find that the current court personnel management is a single administrative management system,from the president to the president to ordinary judges,and even clerks are all in the administrative hierarchy system.The promotion and development of these personnel depend on the improvement of the administrative hierarchy,which is fixed in our country and needs a certain time limit to achieve promotion,the promotion channel is too narrow.The narrowness of promotion channels inevitably affects the enthusiasm of judicial personnel,the efficiency and quality of judicial adjudication,and even the negative idle work phenomenon when a monk strikes a bell one day.This is not conducive to the process of rule of law in our country,affects social equity and affects the credibility of the judiciary.Therefore,it is important to accelerate judicial reform and realize the classification management of judicial personnel.It goes without saying.To promote the reform of classified management of people's courts personnel,we must adhere to the trial-centered approach,highlight the status of judges as the main body,establish a scientific classification,clear division of labor,reasonable structure and judicial professional characteristics of the court personnel management system,so that "the adjudicators adjudicate,the judges are responsible",realize the scientific classified management of all types of court personnel,and continue to promote the regularization and professionalism of the court team.The construction of modernization and professionalization ensures that judges exercise judicial power in a lawful and fair manner.With the help of the analysis of the practice,effect,predicament and causes of personnel classification management in the current round of reform of L City Court,this paper draws lessons from the mature management models of Britain,the Netherlands and the United States,and the first batch of pilot projects in Shanghai,Guangzhou and Hainan,and achieves certain results,in order to improve the reform of L City Court,and hopes that through the reform and improvement of L City Court,other situations can be compared.Similarly,the grass-roots courts play a certain role in drawing lessons from it,speeding up the process of legalization and ensuring the legal interests of the masses.
