Study On Provincial Supervisory Committee's Internal And External Restriction And Supervision Mechanism

Since the 18 th National Congress of the Communist Party of China,the Party and the state have attached great importance to the work of building an honest government and combating corruption.In November 2016,the Party Central Committee decided to launch pilot work on the reform of the national supervision system in Beijing,Shanxi,and Zhejiang Provinces.In March 2018,the National Supervision Committee was officially established,and China 's state-province-city-county four-level national supervision system was formally completed.The Supervisory Committee,as the power of the state's integration of anti-corruption resources and product of the reconstruction of power-supervision framework,has an independent status of the executive,judicial,and prosecutorial apparatuses,and has implemented supervision over all personnel exercising public authority through the constitutional supervisory power.The supervisory committee has a high political status and great power,but if its power is not restricted and supervised,it will not only cause the alienation of power,undermine the original intention of the reform of the supervisory system,turn the righteous into the source of evil,and even shake the ruling foundation of the Party,bringing incalculable losses to both the party and the state.This article takes the provincial supervisory committee as an example,focusing on the problems of the weak internal control and supervision of the provincial supervisory committee,the prominence of the integrity risk in the case investigation process,and the ineffective external control and supervision,and make an in-depth analysis of the limited effectiveness of self-supervision of the provincial supervisory committee,inadequate laws and regulations,lack of initiative from external agencies,and low participation of society and public opinions.By drawing on the advanced experience of the Singapore Corruption Investigation Bureau and the Hong Kong Independent Commission Against Corruption,combined with specific cases and work practices,the article explores the internal and external control and supervision mechanism of provincial supervisory committee,in respect of strengthening the leadership of the Communist Party of China,strengthening control and supervision of the superior-to-inferior level and the internal level,optimizing internal system regulations,improving the restriction and supervision mechanism of the authority,the judiciary and the law enforcement agency,giving full play to the advantages of democratic control and supervision,and creating a social and public atmosphere.
