The ocean absorbs carbon dioxide produced by human activities.When carbon dioxide is dissolved in seawater to form carbonic acid,which lowers the ocean's p H value,it forms ocean acidification.Ocean acidification is another new environmental problem caused by carbon dioxide emissions after climate change.Ocean acidification governance has not yet reached a consensus in the international community.As of now,no environmental convention can be specifically used to solve the problem of ocean acidification.The existing international environmental legal system aims to solve climate change problems,protect the marine environment and biodiversity,and has certain reference significance for ocean acidification treatment,but it cannot cover the entire content of ocean acidification treatment.The purpose of this article is to sort out the existing international ocean acidification governance legal system,and analyze the problems and reasons of the existing legal system,to make recommendations for improving the international ocean acidification governance system,while focusing on the Chinese perspective,and to propose a response plan for China's response to the ocean acidification crisis.The full text is divided into three chapters.The first chapter summarizes the basic situation of ocean acidification and the existing legal system of ocean acidification control.As a new type of marine environmental problem,ocean acidification has not been widely understood and acknowledged.Therefore,the first section of the article gives an overview of the ocean acidification problem itself,mainly from three aspects: the definition of ocean acidification,its causes,and its harmful consequences.The second section of the article systematically sorts out the content related to ocean acidification management in the existing international legal system,and divides it into international treaties,resolutions of international organizations,and regional research results according to the level of effectiveness,so as to construct the basic framework of the existing ocean acidification legal system.The second chapter analyzes the existing problems of the existing legal system of ocean acidification,which is dominated by climate change,from the macro and micro perspectives on the basis of combing the existing legal system.Macro issues mainly include blank legislation in the field of ocean acidification governance,fragmentation of the legal system,and international soft law,etc.Micro issues mainly include the conflict between overall governance in climate governance and ocean acidification governance,and lack of implementation standards for national independent contributions,which is difficult to achieve Temperature control objectives,division of marine areas,neglect of environmental integrity,and difficulty in promoting ocean acidification treatment.Through analysis,it is found that the problems existing in the existing legal system may lead to the dilemma of ocean acidification treatment,and the causes are found to find the source of the problems.The reasons for the above problems are specifically explained,and the problems raised below are echoed with suggestions.Based on the previous analysis of the problems and causes of the existing legal system of ocean acidification,the third chapter proposes that the primary task of improving the existing legal system of ocean acidification is to enhance the international community's awareness of ocean acidification issues,promote international legislation on ocean acidification,and strengthen The interconnection of existing international legal systems promotes the transformation of ocean acidification governance systems from international soft law to international or domestic law,incorporates ocean acidification governance into existing environmental governance systems,and gives full play to the role of national independent contributions to build a multi-level ocean Governance system.At the same time,in the context of the "marine power" strategy,it provides suggestions on how China can respond to the threat of ocean acidification.
