Work-related injury identification is the basis of the work-related injury insurance system.It is the key to determining whether the injured workers can enjoy the work-related injury insurance benefits.It is also the basis for determining whether the employer needs to bear the work-related injury insurance liability,and plays a vital role in the entire work-related injury insurance system.Therefore,it is very necessary to study the status quo of work-related injury identification in China,find out the problems in the work-related injury identification,analyze the causes of the problems and find a way to improve the work-related injury identification system in China.China's work-related injury identification system started late.Although it is gradually maturing with the development of society and practice,there are still many problems in the overall system design and specific implementation details.There is a relatively large room for improvement.Based on the research on the theory,legislation and experience of work-related injury identification at home and abroad,combined with the status quo of work-related injury identification in J District of Changzhou City,this paper summarizes some outstanding problems in the identification of work-related injuries in J District at the level of identification subject,identification standard,identification applicant and identification procedure.Taking the 12,416 work-related injury cases in J District in 2013-2018 as the research object,this paper has comprehensively analyzed the status quo of work-related injury identification work in J District from various aspects such as organization structure,work flow,application status,conclusions,work-related injuries and other aspects of work-related injury identification.And the problems and confusions in the practice of work-related injury identification in J District were summarized.For example,insufficient work-related injury identification personnel,imperfect work-related injury identification standards,insufficient work-related injury identification publicity,work-related injury prevention lag,work-related injury identification participation rate is low,work-related injury identification cycle is lengthy,work-related injury identification administrative mediation mechanism is not perfect,etc.At the same time,interviews were conducted on some work-related injury identification staff and work-related injury identification applicants to analyze the difficulties and deficiencies in the work-related injury identification from multiple angles and all directions.In view of these difficulties and deficiencies,at the end of this paper,it is proposed to find out the best way to improve the work-related injury identification in J District from the four aspects of work-related injury identification subject,work-related injury identification standard,work-related injury identification applicant and work-related injury identification process.By improving the professional level of work-related injury personnel and exploring the socialization of work-related injury identification agencies to solve the problems in the subject of work-related injury identification;by improving the "three elements" standard of work-related injury identification,improving the standard of work-related injury identification in commuting accidents,and improving the standard of sudden illness death as a work-related injury to solve problems in work-related injury identification standards;by increasing the work-related injury identification propaganda,carrying out work-related injury prevention,and expanding the scope of work-related injury insurance coverage to solve the problems existing in the work-related injury identification applicant;by simplifying the work-related injury identification process,shortening the work-related injury identification period,and improving the work-related injury identification administrative mediation mechanism to solve the problems in the work-related injury identification procedures,Through this series of measures,it is hoped that the work-related injury identification system can be improved,and in practice,the work-related injury identification decision can be made more timely and accurately,thereby reducing work-related injury disputes and better protecting the rights and interests of workers injured as work-related vulnerable groups.
