As China enters the aging society,how to alleviate the social pressure of increasing population aging and the increasing number of disabled elderly is a question worthy of study.The research on the legal issues of long-term care insurance for the elderly,as new type of insurance,is still in the pilot stage in China.Scholars actively participate in the research,which is conducive to solving various problems in the pilot insurance.Throughout the academic research,the literature from the legal perspective is still very limited.Therefore,it is necessary to analyze the legal relationship and legal problems in the long-term care insurance of the elderly from the legal perspective,and this is also the value of this study.This paper reviews the development process of long-term care insurance for the elderly in China from the perspectives of commercial insurance and social insurance,and summarizes the insurers and insurants in the pilot areas,using the methods of literature research and empirical research,and with the help of commercial insurance and social insurance.Fund raising is different from the characteristics of traditional insurance.The research shows that the laws and regulations of the long-term care insurance for the elderly have not been issued in our country,the relationship between the insurance and the related insurance is not clear,the financial support of the government is insufficient and the supervision is weak.The author thinks that in order to protect the rights and interests of the disabled elderly,the relevant legal system should be formulated from the angle of legislation,the relationship between the types of insurance and the responsibility of the government in view of the above-mentioned legal problems.
