Intervention Research On Social Work In Mediation Of Family Disputes

In recent years,with the continuous development and progress of our country's society,new situations and new problems in marriage and family relations are constantly emerging.The number of family disputes continues to grow and types are increasingly diverse.This has brought tremendous challenges to traditional family dispute mediation.Family dispute mediation urgently needs innovative ways and introduces professional social workers.This paper studies the intervention of social work in family disputes.First of all,this paper has combed the history and reality of family dispute mediation in China.From ancient times to now,mediation has always played an important role in family disputes.However,today's family dispute mediation still has some problems,such as insufficient support from social forces,imperfect mediation mechanism and surface recognition of mediation value.Secondly,this paper analyzes the necessity of social work intervention in family dispute mediation.The necessity shows that social work can meet the requirements for specialization,professionalization and differentiation of family dispute mediation.In addition,social workers and mediators have a good fit in core values,professional abilities,and psychological quality.Again,this paper takes the J District People's Court of Shanghai as an example to compare the mediation of asocial worker and a non-social worker through the way of participation in observation and in-depth interviews,to highlight the advantages of social work intervention in family dispute mediation,and then suggest three approaches for social work intervention.From the perspective of practical philosophy,mediation between the social worker and non-social worker are all helping activities to maintain marriage and family relations,but social workers emphasize self-help,namely,tap the potential of clients,let them rebuild their understanding of family and control their lives with their own strength;From the perspective of practical theory,the social worker used crisis intervention theory and empowerment theory to help minor corrects negative emotions and made her take the initiative to act as a reconciliation agent between parents to save the families on the verge of breaking up.The non-social worker has not yet formed a theory,he can only adopt the persuasive method and emphasis laws,and the lack of scientific and professional judgment can't meet the complex needs of family disputes;From the perspective of practical modes,the social work used therapeutic mediation model,and the non-social worker used educative mediation models.We can't say which mediation model is better,they have certain commonalities in some aspects.but combining family mediation with professional social work can provide a brand-new idea for our country's family mediation model;From the perspective of practical wisdom,the wisdom of social workers from the grasp of professional knowledge and skills,while non-social workers' wisdom come from experience.In contrast,experience is subjective and one-sided,professional knowledge reflects the professional service;From the perspective of life experience,both social workers and non-social workers need to have the ability to understand and reflect on marriage and family life.There are three ways for social work to intervene in family dispute mediation.The upper path is to formulate relevant policies for social workers in family dispute mediation;the cooperative path is to set up a special family mediation social work organization to cooperate with courts;the embedded path is courts set up family mediator posts so that social workers can be embedded within the court system.Finally,this paper puts forward some reflections and suggestions on the intervention of social work in the mediation of family disputes.Social workers' participation in family dispute mediation not only enables the parties to establish trust relationships,improve their self-healing skills,regain their confidence in life,but also create a family trialmechanism and expand the social work service area.However,social workers have encountered some difficulties in the mediation of family affairs.For example,the division between social workers and non-social workers is unclear,the lack of follow-up after mediation,the mismatch between the professional process of social work and the mediation procedure.Therefore,this paper proposes that we should establish evaluation system and division mechanism,give full play to the role of social work before or after mediation,and strengthen the construction of social work itself,in order to further play the role of social work in family mediation.With the transformation of Chinese society and the emergence of multiple family conflicts and problems,the professional strength of social work to solve family conflicts can make family dispute mediation more professional and efficient.The research in this paper aims to promote the application and development of social work family dispute mediation,and reflects the social governance function of social work for “home and everything”.
