Research On China's Rural Environmental Liability Insurance System

In the past decades,proposing the thought of taking economic construction as the center,the national economy has been rapid ascension,at the same time,the form is becoming more and more serious environment,endanger human survival environment,in order to normalize model of development between urban and rural areas,the rural and urban in such aspects as economic development and environmental protection gap is widening,the rural ecological environment more vulnerable.Due to the cost of production has increased,more and more companies from cities to rural areas,frequent around environmental ecological problems.As the origin and development of environmental liability insurance in our country,due to imperfect legal system,poor environmental protection consciousness,backward infrastructure,low environmental governance,environmental quality in rural areas is difficult to be effectively improved,therefore,the ecological compensation fund,such as environmental tax theory research arises at the historic moment,according to the socialization of environmental tort relief,ecological integrity,insurance,basic principles,such as theory,construct suitable for the actual environmental liability insurance in rural areas,to promote environmental protection and tort relief way to diversify.From the perspective of ecology,environmental ethics,law and economics at urban and rural environmental pollution problems and hidden the relationship between human and ecological environment,rural environmental liability insurance system draws lessons from foreign developed countries on the environmental liability insurance theory and practice experience,and combines the characteristics of the rural environmental pollution,play to fill the damage and environmental control,expand the scope of insurance enterprises,attracting more and more small and medium-sized sewage enterprises,with the state of environmental pollution liability insurance form the double-track system,to achieve synchronous development of rural and urban environmental protection,benefits farmers rights and interests at the same time,and is given priority to with efficiency first,management principles,to achieve the purpose of improving the rural environment.The first part of the article is to introduce the basic definition,connotation,characteristic and function of the rural environmental liability insurance.Through the analysis of the difference between rural environmental liability insurance,agricultural environmental liability insurance,and the environmental liability insurance,we can clear positioning of rural environmental liability insurance with the method of comparison,and have a preliminary understanding.The second part is firstly to provide theoretical support for the rural environmental liability insurance system from multi-angle of law,economics,and ethics.Secondly,we discuss the main necessity of rural environmental liability insurance,from the perspective of farmers,enterprises,each national bodies.Finally,from the consciousness of environment,economic environment and domestic experience,we discuss the feasibility of the rural environmental liability insurance.The third part is to establish a main goal and a direction of this system,and provide reference for construction of concrete system through the analysis of difficulties in rural environmental liability insurance system of the main building,and combining with the status and characteristics of China’s rural.The fourth part is to build China’s rural environmental liability insurance for the purpose,through draw lessons from and absorbing foreign successful experience and theory,analysis,summary,induction is applicable to the principle of environmental liability insurance in the rural areas.From the analysis of the pros and cons of the system,the perspective of innovation,design the concrete system of rural environmental liability insurance and the supporting system.
