Discrimination And Analysis Of Legal Documents Unearthed In Turfan

Through the study of the legal documents unearthed in Turpan,this paper reveals the similarities and differences of judicial implementation in Turpan and Central Plains.The documents unearthed in Turpan cover a wide range of contents,legal documents occupy a small part,and judicial system(here the judicial refers to the narrow sense of the judicial system,only on civil disputes,civil disputes and so on).Documents that do not involve the operation of legal systems at the macro level,such as the study of official system,account for the majority of them.According to ten volumes of<Turpan unearthed documents>[Research Room of Ancient Documents of State Administration of Cultural Relics,Museum of Xinjiang Uygur Autonomous Region,Department of History of Wuhan University:Turpan unearthed documents(10 volumes of interpretation),Cultural Relics Publishing House,1981-1990.]he relevant judicial system documents have been sorted out.Among them,there are forty-five legal documents concerning diction,six legal documents conforming to the law,fifteen legal documents of dies,six fus,three case files and eleven other legal documents.The content of this paper is divided into four chapters.The first chapter is mainly about sorting out and researching the lexical documents.This type of documents accounts for the highest proportion in the ten legal documents unearthed in Turpan.There are forty-five lexical documents.The lexical documents are generally procedural documents from the bottom to the top of the civilian population.They cover land rent disputes,theft and wounding,escape from corvee and other categories.Through sorting out,collating and explaining the dictionary,and combining with the Tang law,this paper studies the content of the dictionary,and analyses the format of the dictionary,the litigation procedure of the dictionary and the result of the trial.Finally,it summarizes the characteristics of Tang law reflected in dictionaries.The second chapter mainly discusses the official documents.Fifteen official documents are listed first.The official documents unearthed in Turpan account for a small proportion of the legal documents.Most of the contents are the cases declared by the lower authorities of Xizhou prefecture to their superiors,solving public and private cases such as land rent disputes,death of expropriation,stolen goods and so on.Through sorting out,proofreading and explaining the documents,and combining with Tang law,this paper explores the contents of the documents,and analyses the format,litigation process and trial results of the documents.The third chapter mainly discusses the fu[a form of documentation by government]documents.Firstly,the list of six fu documents is arranged.The proportion of fu documents in the legal documents unearthed in Turpan is relatively small.The fu documents are the downstream documents from the top to the bottom of the Xizhou government.The content of fu documents is mostly to search for public and private cases such as slavery,violation of lessons,and disorder of wives and concubines.Through sorting out,collating and explaining the symbolic documents,and combining with Tang law,this paper explores the content of the symbolic documents,and analyses the format and communication procedures of the symbolic documents.The fourth chapter mainly discusses the legal files.Firstly,three files are introduced.One of the files is composed of the above-mentioned words and documents,which have been explained above.Therefore,this part focuses on two other file documents.The files and documents are relatively complete,showing the trial procedure of judicial cases in Xizhou prefecture.By collating and explaining the documents of the case files,the author makes a detailed study of the marriage disputes and traffic accident crimes involved in them.Through the study of the legal documents of diction,title,symbol and case in ten volumes of Turpan Unearthed Documents,this paper explores the judicial implementation in Turpan,and analyses the reasons for the changes of Tang law in Turpan,and summarizes the reasons,aiming to provide reference for the legal construction in today's border areas.
