Research On The Control Of The Discretionary Power Of Administrative Penalties In Market Price Supervision

Administration by law is the need of building a harmonious society and a government ruled by law.Price law enforcement undertakes the responsibility of maintaining social price order,promoting the healthy development of the socialist market economy,and protecting the legitimate rights and interests of consumers and operators.It is a concrete manifestation of law enforcement officers administration according to law.Laws and regulations give law enforcement agencies the power of discretion in administrative penalties.At the same time,the attribute of "freedom" brings the risk of abuse,which is prone to adverse social problems and social impact.Therefore,it is necessary to control the discretion of administrative penalty in the field of market price supervision.The author collects and consults a large number of domestic and foreign research results for this research topic,and tries to summarize the meaning of administrative penalty discretion in market price supervision by using literature research method and comparative analysis method.Based on administrative control theory,administrative supervision theory and street bureaucracy theory,the author uses case study method and comprehensive investigation method to summarize the current market price.In view of the problems existing in the discretion of administrative penalty in the field of quality supervision,this paper analyses the causes from the external and internal aspects in order to better realize the purpose of price enforcement and discretion through six aspects: legislation,judicature,administrative procedure,law enforcement principles,administrative ethics and personnel management.Use the original intention.Standardizing the discretion of administrative penalty is one of the contents of building a government ruled by law.To exercise the discretion of price administrative penalty correctly is to find the best combination point to avoid abuse of power and exert the administrative efficiency of price,so as to maximize the advantages of the discretion system of administrative law enforcement.Through the preliminary study of this article,we hope to promote the market price supervision and management department to enforce the law honestly and efficiently.
