Legal Thinking On The Innovation Of Police Work Under The Background Of Big Data

With the popularization of iconic technologies such as cloud storage and cloud computing,human beings have entered the era of big data.Data is growing exponentially,and using big data to solve problems has become one of the solutions in various industries,as is police work.The policing is literally interpreted as the police's mission,service,and police data can be understood as data collected and used to complete the police's mission.The emergence of big data has opened up a new way of production,life,and management,while police big data represents a big data-based policing mode.On the one hand,we need to use big data to cope with the increasingly serious illegal activities to protect the public order;on the other hand,the people also need us to use big data to provide more convenient services.In practice,work innovation based on police big data has become the norm in the work of public security organs at all levels,and has become an important development trend of new police work.The development of police big data has enabled public security organs to better understand the objects of police work.At the same time,big data has also promoted the socialization of police work,made police work more democratic,and enhanced the ability of police work to predict and warn.However,while the innovation of all kinds of big data policing work is booming,we do not have a unified understanding of the legal terms involved in big data.Based on the analysis of the legal attributes of data by many scholars,this paper re-analyzes the legal attributes of data and defines and interprets some important legal terms.This paper believes that data has public rights and private rights.Data public rights are divided into data sovereignty and data power from both external and internal perspectives.Data sovereignty refers to a country's exclusive power to manage and control its own data.It shows that a country has the right to decide the procedures and ways to participate in international data activities,and has the right to take necessary measures to protect its data rights that infringed by other countries.Data power is an extension of state power in the data category and has the power of power.As a state violence agency,the public security organs exercise data power in various policing tasks such as internal crime prevention,public security,and population management.In the current innovations of various police work,the public security organs have emphasized the use of data power and neglected the protection of citizens' rights and interests.Therefore,in this context,data privacy rights is an important means for citizens to fight against data power.It is especially important to list them for discussion.Data privacy rights mainly include data right to know,forgotten right,data personality right,and data property rights.In addition,this paper also discusses the justification of police big data,mainly including the authorization of national laws and the need to meet people's growing security needs and access to efficient and convenient services.The use of police big data has also brought new legal obligations to the public security organs,such as new law enforcement burdens and data disclosure obligations.Based on the analysis of the legal attributes of data,this paper proposes a series of legal issues and countermeasures around the innovation of police work.First,the data hegemony brought about by the international data monopoly,the author of the data hegemony proposed the principle of constructing international data jurisdiction;the second is to regulate the exercise of data power,mainly including data collection rights and big data investigation,the author proposed a series of norms Data collection and big data detection measures;third,to protect the data privacy rights,the author proposed to protect citizens' right to erase and equal rights;Fourth,the public security organ data management system,the traditional data management structure constrained the big data police Innovative development of work should build a scientific data management system.
