Legal Problems And Perfection Of The River Chief System In China

The River Chief System is a system of river basin coordination and governance that was born under the administrative management system.The person in charge of the party and government is the river head and is responsible for the management and protection of rivers and lakes in its jurisdiction.To some extent,the theory of river basin comprehensive management,the theory of holistic governance,the theory of the same responsibility of the party and the government,and the theory of environmental personality rights provide the theoretical basis for the birth of river system.China’s river system has gone through more than ten years,from local to central,from pilot to full implementation.The implementation of river chief system has promoted the protection of river and lake system and the overall improvement of water ecological environment,but there are still many problems in the legal level to be further improved.Jiangxi Province,as the first demonstration province of national ecological civilization construction,river director system is an important content in the innovation of river and lake management system.Taking Jiangxi River chief system as a sample,this paper makes a comprehensive and detailed analysis of the legal issues of China’s River chief system,which is beneficial to the improvement of the legal theory system of river chief system and the promotion of river basin management practice.For this reason,this paper takes Jiangxi Province as a sample to make an empirical study on the implementation of river chief system in China.Based on the investigation of the background and development,laws and policies,main contents and specific implementation of the system in Jiangxi Province,it is concluded that there are four legal problems in the implementation of the system in China,including over dependence on administrative orders,unscientific assessment and accountability methods,unclear nature and status of the organization system,and insufficient public participation.In order to improve the river system,this paper expounds the river basin management practices of the Rhine,Thames,Singapore and Tennessee rivers in Europe,and draws on useful experiences from three aspects: legislative measures,accountability measures and public participation measures.The legalization of river chief system is the internal requirement to promote the modernization of national governance system and governance capacity.Based on the above analysis of the legal problems existing in river chief system and the experience of foreign river basin governance,this paper focuses on strengthening the construction of river chief system legal system,speeding up the establishment of perfect examination and accountability system,clarifying the nature and status of river chief system organization,and improving the public participation in the whole process Four aspects of mechanism construction put forward relevant countermeasures for the improvement of river chief system,hoping to provide reference for the future development of river chief system in China.the article consists of the following four parts,as follows:The first part is an overview of the River Chief System.It mainly introduces the concept of river long system and where our country’s river long system comes from.It also expounds the theoretical basis of the existence of China’s River Chief System at the theoretical level.The second part is the practice of Jiangxi River chief system and the analysis of the existing legal problems.From the perspective of empirical analysis,this article analyzes the implementation of the River Chief System in Jiangxi Province,and mainly expounds the implementation situation and current situation of the River Chief System in Jiangxi Province.The third part is an analysis of the legal problems in the River Chief System in China.Through the analysis and exploration of the implementation of the River Chief System in Jiangxi Province,it reveals the legal problems that still exist in the implementation of the River Chief System,mainly including the implementation of the River Chief System that relies too much on administrative orders,unscientific assessment and accountability methods,Four legal issues,such as unclear status and insufficient public participation,provide solutions for the following countermeasures by analyzing the existing legal issues.The fourth part is the inspiration of extraterritorial river basin governance experience.It mainly selects foreign beneficial experiences in water environment river basin governance,and improves the implementation of China’s River Chief System by absorbing and drawing on the extra-territorial beneficial experiences.The fifth part is the countermeasures to improve the River Chief System.Based on the above analysis of River Chief System and the experience of extraterritorial watershed management,we make specific suggestions for the legal problems existing in China’s River Chief System,with a view to further improving the implementation of China’s River Chief System.
