Research On The Legislation Issues In The Construction Of Qilian Mountain National Park

Qilian Mountain national park,as the "safety barrier" in northwest China,has an irreplaceable ecological status.The ecological environment in qilian mountains has been seriously damaged for a long time,and the original protected land system cannot solve the contradiction between ecological protection and economic development,which makes the ecological destruction of the natural protected land more serious,but also limits the development of local economy,making the contradiction worse day by day.The 2017 "general plan for the establishment of the national park system" proposed the establishment of a system of nature reserves based on national parks,clarifying the importance of national parks.National parks adhere to the ecological concept of "protection first,rational use",and take the protection of ecological resources as the first priority.At the same time,they also have the functions of scientific research,education,recreation and so on,thus solving the long-standing contradiction of nature reserves.In 2017,the central government passed the pilot program for the qilian mountains national park system,which opened a new chapter of ecological protection in the qilian mountains.At present,the construction of the qilian mountains national park is being promoted step by step and certain achievements have been made.Although the central and local governments have formulated some policies on the construction of qilian mountain national park,the construction of qilian mountain national park cannot be effectively protected by law due to the lack of national park legislation.Therefore,how to perfect the legislation and build relevant important systems is an urgent problem to be solved.This paper mainly discusses and studies the legislation of the construction of qilian mountain national park.The first chapter mainly analyzes the present situation of the construction of qilian mountain national park,discusses the general situation of the national park,sorts out the historical development of the construction of qilian mountain national park,and analyzes the current achievements.The second chapter mainly expounds the current situation analysis of the system barrier of the construction of qilian mountain national park,mainly analyzes the current situation of the system guarantee from the policy and legal system,and puts forward the main problems.Chapter three mainly analyzes the legislative experience of national parks in the United States,New Zealand and Japan,mainly analyzes the management system and legislative overview,and analyzes the three national parks in China,so as to establish and improve the relevant system of the construction of qilian mountain national park by referring to the legislative experience at home and abroad.The fourth chapter analyses the legislative Suggestions to perfect the construction of qilian mountain national park,from the analysis of domestic and foreign experience andcombining the actual situation of the qilian mountain national park,to perfect the legislation problems of the construction of the qilian mountain national park,mainly It mainly includes clarifying the legislative concept,model and principle,and improving the management system,fund guarantee system,public participation and ecological compensation system.
