Gansu Province’s Implementation Of The Wildlife Rotection Law Of The People’s Republic Of China

The "Measures for the Implementation of the Wildlife Protection Law of the People’s Republic of China"(hereinafter referred to as the "Measures")is a local implementation legislation for wildlife protection in Gansu Province,which will be included in the preparatory project of the legislative plan of the Standing Committee of the Gansu Provincial People’s Congress in 2020 and 2021 due to the epidemic factors.The purpose of the post-legislative evaluation of the full text of the measures is to improve the legislative quality of the text and maintain the biodiversity and ecological balance in Gansu province.This paper clarifies the theoretical basis of the qualification of the appraisal subject,the selection of the appraisal object,the selection of the appraisal method and the composition of the index system of the law school and department.On this basis,this paper adopts text quality assessment and implementation effect assessment as the first-level index system,and legitimacy,rationality,standardization,coordination,operability,local characteristics,effectiveness and public satisfaction as the second-level index system.The overall evaluation result is 66 points.The Measures should be moderately revised,but there is no need for major overhaul.In terms of text quality,the legality and standardization of the Measures are good,but the overall evaluation of rationality and operability is low,and there are many problems in coordination and local characteristics.In terms of the implementation effect,the Measures have been recognized by administrative law enforcement organs,the number of administrative violation cases has been reduced,the degree of public acceptance and satisfaction is acceptable,but the public’s understanding is not good.To the problems arising from the evaluation,Suggestions to consummate the legal liability chapter content,respectively in the legislative purpose to join "against public health risk",adjust the individual to the standardization of terms and expressions,integrated text consistent with host law,expand the contents and strengthen the operability,rich local characteristics content,perfecting the law enforcement team construction proposal.
