Research On Compensation System For Ecological Environment Damage

Compensation for damage to the ecological environment is a monetary manifestation of the liability of the responsible person,and it should be understood in a broad and narrow sense.In a broad sense,compensation for damage to the ecological environment includes,but is not limited to,compensation for restitution and compensation for losses,that is,income from damages.In a narrow sense,compensation for damage to the ecological environment is the legal consequence of "compensation for loss" for damage to the ecological environment.It does not include repair costs,but includes monetary compensation for permanent damage to the ecological environment,that is,income from compensation for losses.There are two ways to obtain compensation for ecological damage: litigation and non-litigation.Litigation methods include environmental civil public interest litigation and ecological environment damage compensation litigation.Non-litigation methods include negotiation,reconciliation,and mediation.With the promulgation of the "Eco-environmental Damage Compensation System Reform Plan",some provinces and cities in my country have formulated the ecological environment damage compensation fund management method,which stipulates the source of compensation,management mode,use scope and use method,objectively It also provides guidance for the management and use of compensation funds for ecological environment damage,but there are still many problems in practice,mainly including the following aspects: first,there are problems in the use and management of compensation funds for ecological environmental damage;second,ecological The determination and calculation standards of the amount of compensation for environmental damage are in confusion;thirdly,the socialization mechanism of compensation for ecological environmental damage is lacking.There may be many reasons for these problems,including imperfect systems,short time for reform exploration,insufficient experience,and more preconditions for the payment of compensation.my country has not formed its own scientific standard system,nor has it established an operational identification system and other related systems,and there are deficiencies in system design and connection.In response to the above problems,the path of improvement in this article is mainly divided into the following three parts: firstly,it proposes to improve the problems in the use and management of compensation in practice;secondly,it analyzes the identification standard of ecological environmental damage and determines the ecological environmental damage.Standard;The last is to build a system of guaranteeing funds for compensation,that is,to build a diversified funding source channel and a resource source supervision system.The above three parts provide suggestions for the improvement of my country’s ecological environment damage compensation.
