Research On Public Participation System In Environmental Impact Assessment

With more than 40 years of reform and opening up,China’s social and economic development has progressed by leaps and bounds,and the 19 th CPC national congress also announced that China has entered a new era.However,China’s environmental pollution has been increasingly intensified,and major accidents or mass incidents caused by environmental problems have occurred continuously.The worsening of the environment has also led China to enter the environment risk society.The environmental impact assessment system is an environmental legal system set up to prevent and mitigate the possible adverse impact of planned projects or programs on the environment,and it is also an important way to effectively reduce social conflicts caused by environmental problems.Among them,public participation,as a key link of environmental risk regulation,plays an important role that cannot be ignored in environmental impact assessment system.On the one hand,public active participation in environmental impact assessment reflects the democracy of environmental impact assessment system design;on the other hand,it also highlights the social concept that everyone is responsible for environmental protection.In a word,public participation is related to the actual effect of environmental impact assessment system and plays an irreplaceable role in this system.This paper studies the public participation system in environmental impact assessment.Firstly,from the theoretical point of view,this paper summarizes the relevant theories of public participation system in environmental impact assessment,and systematically expounds its theoretical basis and the necessity of implementation.Secondly,from the empirical perspective,it is concluded that although the public participation system of environmental impact assessment in China has made achievements,there are many problems.Compared with developed countries,the public participation system of environmental impact assessment in China still has some shortcomings,such as too general participants,relatively narrow scope of participation,single participation way,lag of participation stage and absence of judicial relief of public participation.Therefore,this paper mainly discusses the environmental impact assessment system in the United States and Japan from the aspects of participants,participants,participation stage and participation mode,and compares it with the existing system in China.Finally,aiming at the shortage of public participation in environmental impact assessment system based on the reality of our country and draw lessons from foreign advanced experience,from the way of public participation in environmental impact assessment,the applicable scope,relief path Angle put forward to perfect our system of public participation in environmental impact assessment of targeted Suggestions,hoping to improve the system of environmental public participation in our country.
