Research On Ecological Environmental Protection System From The Perspective Of Chinese Constitution

In order to better solve environmental problems,our country has been working hard.In the report of the 18 th National Congress of the CPC in 2012,the construction of ecological civilization was placed on the height of the overall development of the country and set the building of a “Beautiful China”as the overarching goal of ecological civilization construction.In 2017,the report of the 19 th National Congress of the Communist Party of China put forward that the modernization we are going to build is the modernization of harmony between man and nature.One year later,The Party and Government Policy has been further elevated to the national will,ecological civilization was clearly written into the constitution,which has a great influence on the improvement of China’s ecological environment protection system.We can find that the constitution ecological environment protection itself is not an isolated concept,and the gradual perfection of the constitution environmental clause is the expression of the accumulation of the constitution ecological environment protection achievements.In addition,the ecological environmental protection of the constitution has the functions of providing guidance for the improvement of legislation,providing guidance and judgment standards for the formulation of various policies,providing interpretation basis for the law enforcement and justice of the ecological environment,and clarifying the law-abiding obligations of the ecological environmental protection of various subjects.The research on the protection of the ecological environment of the Constitution is mainly based on the constitutional provisions of the protection of the ecological environment,and revolves around the embodiment of the constitutional ecological environment provisions in the Civil Code and other department laws.After knowing the current situation of the theory of ecological environment protection in the constitution,the analysis of the current ecological environment protection in our constitution failed to clear the environment right problem exists in the practical level,ecological environment system of the legislation is not perfect enough,ecological environment protection law enforcement system has abuses,the ecological environment of judicial level is not high,and the ecological environment problems such as insufficient law-abiding consciousness.To some extent,these problems restrict the implementation of ecological environmental protection in the constitution of our country.In order to better solve various problems existing in the practice of constitutional ecological environmental protection in China,the author compared and analyzed the views of the current academic circles on such problems,and drew lessons from the practices of foreign countries.The solutions to the above problems can be obtained from the following perspectives: To establish the legislative provisions on environmental rights in China,improve the legislative system,establish and perfect the law enforcement system of ecological environmental protection,improve the judicial level of ecological environmental protection and enhance the awareness of the people to obey the law of ecological environmental protection.
