| China is in the period of concentrated outbreak of environmental problems,and environmental problems are becoming more and more serious.In order to solve the environmental problems,China has developed the government control model and market regulation model,but they all seem to fail.Obviously,a single entity cannot deal with environmental problems independently,so a pluralistic co-governance environmental governance model has emerged.The environmental obligation of the government is a part of the government’s environmental responsibility,which is its prime responsibility.By clarifying the environmental responsibility of the government,the government’s point of effect in environmental governance is identified,which helps to solve environmental problems in a better way and realize the environmental responsibility of the government.In the environmental governance model of pluralistic co-governance,the government plays more of a service provider role.Thus,the study of the government’s environmental responsibilities is modeled on a service-oriented government.Based on this,the environmental responsibilities of the government are mainly:the responsibility of guaranteeing environmental quality,the responsibility of guaranteeing environmental information disclosure,and the responsibility of guaranteeing environmental public participation.However,in practice,all three responsibilities have different problems:the responsibility of guaranteeing environmental quality has unclear subjects,unclear ways of assuming responsibility,insufficient disclosure of environmental quality information,and inadequate supervision;the problems of guaranteeing environmental information disclosure are mainly manifested in the lagging time,backward ways of disclosure,and lack of supervision;public participation is an important support for the model of environmental pluralistic co-governance,however,the government’s role in guaranteeing environmental public participation is an important support for environmental pluralistic co-governance model,however,the government has problems in guaranteeing environmental public participation,such as narrow definition ofp ublic scope,lack of participation methods resulting in insufficient public participation,and inadequate relevant laws and regulations.In this paper,the environmental responsibility of the government is discussed by combining the knowledge of management science and administrative law instead of the existing environmental legislation.Thus,we can not only promote the mutual reference and infiltration of the theoretical contents between different disciplines,break through the weakness of a single discipline in solving environmental problems,enrich the contents of environmental governance theories,overcome the bias in the study of the government’s environmental responsibilities,but also help to clarify the necessary responsibilities of the government and its functional departments in the multi-dimensional environmental governance,clarify the responsibility boundaries between the government and the market,society and other environmental governance subjects,and promote the realization of the government’s environmental responsibilities.This paper is divided into three parts.The first part provides an overview of the environmental governance model of pluralistic co-governance.Firstly,the concept and characteristics are clarified,followed by the reasons for it,including both theoretical foundations and practical needs;then the importance of the government in the environmental governance model of pluralistic co-governance and its performance are discussed.The second part explores the content of the government’s environmental responsibilities in the pluralistic co-governance.There are two assumptions in the discussion,one is the environmental governance model of pluralistic co-governance and the other is service-oriented government.On this basis,it is clarified that the environmental responsibilities of the government mainly include the responsibility of guaranteeing environmental quality,the responsibility of guaranteeing environmental information disclosure,and the responsibility of guaranteeing environmental public participation,and the problems of the three responsibilities are analyzed.The third part proposes suggestions for the improvement of the government’s environmental responsibilities in the context of pluralistic cogovernance.Firstly,the contents of the environmental responsibilities of the government in foreign countries are sorted out,and then the feasible experiences and measures that are worth learning from China are selected;secondly,targeted suggestions are made to address the problems in the second part,in order to help solve the problems. |
