The principle of "polluter pays" is the core idea in the traditional concept of environmental responsibility.However,with the development of the times and the changes of social environment,it is impossible to curb the frequent incidents in today’s vicious environment only by claiming compensation from polluters.It is a new mode to treat environmental pollution in industrial parks to require polluters to pay commissions according to the contract and entrust third-party environmental service agencies to treat the pollution.Its environmental legal liability is no longer limited to environmental civil liability,criminal liability and administrative liability between polluters and third-party goweernance enterprises and governments,but should be regarded as a kind of social responsibility,which is an obligation that all social participants need to bear.It should include the government,enterprises and other social participants.By analyzing the meaning of third-party governance in industrial parks and environmental pollution in industrial parks,combining with environmental pollution cases in industrial parks,this paper analyzes the difficulties existing in third-party governance in industrial parks at present in China,and draws lessons from the advanced experiences and practices of Germany,the United States and Japan in the field of environmental pollution third-party governance,and discusses the commitment of third-party legal responsibility for environmental pollution in industrial parks from the aspects of the formulation of relevant national laws and regulations,the construction of government supervision responsibilities,the prevention and control of enterprise risks and social sharing,and the participation of diversified subjects in third-party governance in industrial parks.
