Problems And Countermeasures Of Supervision Responsibility Investigation Of Environmental Monitoring Inspection And Testing Institutions

The most basic condition for human survival is the environment,and the improvement of the environment is the improvement of people’s livelihood.Improving environmental protection is conducive to improving the sustainable development ability of the national economy economically;Politically,it can reflect the administrative ability of the government and the ruling ability of the Party Central Committee;The society can provide better living environment for residents,which is conducive to the harmonious and stable development of society.At present,China’s environmental problems are serious,which have a great impact on China’s economic development,social stability,people’s life and health,and the image of the government.Environmental monitoring data is an effective way to manage the environment through scientific and technological means in the new era,and this way is the most appropriate and efficient.However,scientific data also needs professionals to supervise,otherwise,in order to whitewash their achievements,some lawbreakers will take a shortcut and make false data.This not only violates the law,but also increases the difficulty of environmental protection and governance.In view of the frequent occurrence of data fraud,the state included environmental data fraud into the criminal offence in 2017 and meted out punishment.But the law is only a means,how to use appropriate methods to fundamentally curb the bad wind of environmental data fraud has become a hot issue in recent years.In this paper,the use of literature analysis,comparative analysis and other methods,around the regulatory accountability,mainly from four aspects of the analysis.Firstly,the concepts of inspection and testing institutions and the consistency of rights and responsibilities are defined.Combined with the theories of social contract,public goods,environmental law and so on,the problems existing in the accountability of environmental monitoring inspection and testing institutions are studied.Secondly,it analyzes the current situation,existing problems,difficulties and reasons of the regulatory accountability of environmental monitoring inspection and testing institutions.This part is an important part of this paper,trying to accurately and comprehensively summarize and analyze the problems,difficulties and reasons of regulatory accountability,so as to provide the basis and reference for the relevant countermeasures in the future.Third,it briefly analyzes the practice of accountability in the United States,Japan and other foreign governments,trying to find the experience and Enlightenment suitable for our country and apply it.Fourth,on the basis of the previous summary,and put forward suggestions and Countermeasures of accountability suitable for China’s national conditions.
