Research On The Medical Security Of Prison Inmates

Prisoner are special social citizens.Although they are restricted or deprived of certain freedoms,they still enjoy the basic human rights of citizens.The right to medical treatment is closely linked to the person ’s right to health,and is closely related to the right to life.It is also an important right that prisoners need to protect.The "big swarm" planned economic medical system is difficult to keep up with the times.The imbalance of the basic medical service supply of prisoners is prominent.The prison medical expenditure is tight and the financial pressure is great.The medical treatment enjoyed by prisoners is much lower than that enjoyed by urban and rural residents in the same region.Although reforms have been carried out in some places to include prisoners in the basic medical insurance system for urban and rural residents,most provinces still use the original model.The prisoner’s medical security system has the following drawbacks: First,the relevant legislation is sloppy and the effect of the law is not good.The legislation does not clarify such issues as the medical security standards of prisoners,procedures for medical treatment outside the insurance,coordination mechanisms of relevant departments.Second,medical security operates at a low level.Prison medical expenditures continue to increase but the medical standards of prisoners are still low.Free medical care,rather than basic medical insurance for urban and rural residents,does not guarantee prison inmates access to good medical services.Third;the supporting mechanism is not running smoothly.Prisoners do not know how to safeguard their own medical security rights;The internal and external supervision of medical behavior can not be implemented.There is a disconnect in the social cohesion of medical care.In view of this,This paper discusses how to improve the medical security level of prisoners from three aspects:Firstly,it believes that the social medical insurance should not exclude the prisoners,and the prison law should explicitly include the prisoners in the basic medical insurance for urban and rural residents,and pay the corresponding insurance fees by increasing the labor remuneration of the prisoners.Secondly,it is suggested that the system of parole for medical treatment should be implemented and measures should be taken to improve the medical security level of prisoners from the aspects of the selection of medical staff and the provision of medical facilities.Aiming at the problem of insufficient medical insurance expense in prison,this paper proposes to solve it by means of support and help from all walks of life and other government departments.Finally,it discusses the ways to protect the medical rights and interests of prisoners from the perspective of supporting mechanisms,including the medical security relief mechanism,supervision mechanism and connection mechanism.In particular,it proposes to actively connect the medical insurance before the reform,the medical insurance after the release of the sentence and the medical insurance in prison and the medical insurance in the social medical insurance.Starting from improving the legislation,improving the medical level and optimizing the medical security mechanism,the author hopes to establish a scientific,standardized and perfect medical security system for prisoners and solve practical problems as soon as possible.
