| Under the background of this new era,with the continuous improvement of medical system and medical technology,the improving quality of medical service and the selfless dedication of the medical staff during the outbreak of the Covid-19,all these provide a good objective environment for building a harmonious doctor-patient relationship.However,the problem of doctor-patient disputes has not been effectively solved,the medical incidents,medical violence still occur frequently,the relationship between doctors and patients is still relatively tense.If the problems cannot be solved effectively,it will seriously threaten the property and even personal safety of doctors,patients and the stability and development of the whole society,and then evolve into an extremely complex social problem.In the long run,it will easily form a vicious circle and become the key point to hinder the construction of a harmonious society.Therefore,it is urgent for all the society to work together to solve the problem of doctor-patient disputes.When analyzing the causes of doctor-patient disputes,there are three main aspects from doctors,patients and society,respectively.Firstly,from the doctors’ sides,it is caused by negligence,irresponsibility,lack of professionalism of the some medical personnel in the diagnosis and treatment process,and also caused by others such as inadequate medical insurance system,unsound relevant laws and regulations,limitations in medical technology and so on.Secondly,from the patients’ sides,when the patients are increasing pursue health rights and interests,but lack of rational attitudes and understanding of their own rights,it will make them either lack of access to rights or excessive amplification of the scope of protection of rights.From the society sides,the incomplete distorted reports from media may result in intensified doctor-patient contradictions.However,the reason is that the relationship between the rights and interests of both doctors and patients has not been effectively coordinated,so how to effectively coordinate the rights and interests of doctors and patients is the key to solve doctor-patient disputes.In order to deal with this problem,our government has made great efforts in conjunction with various departments to issue a number of relevant laws and regulations,and at the same time,various regions have also formulated measures to prevent and solve this problem,and are still improving.To some extent,these policies have played a positive role in the governance of doctor-patient disputes,but still existing many problems and the incidence of doctor-patient disputes still high.Based on balancing the legitimate rights and interests of many parts in medical disputes,this paper,from the perspective of balance theory,analyzed the possibility of improving the governance policy on doctor-patient disputes,discussed the evolution of its four stages,analyzed the characteristics of disputes and the characteristics of policies in each stages,and pointed out that balance is the characteristic of governance policies on disputes.On this basis,this paper analyzed the problems existing in the current policies,and probed the improving suggestions,so as to form a comprehensive coordination of before,in,after the disputes to protect the legitimate rights and interests of both doctors and patients,alleviate the contradiction between doctors and patients,reduce the occurrence of medical disputes,and then maintain social harmony and tranquillity. |
