| Health is related to the happiness of millions of ordinary people and has become one of the important contents of China’s livelihood project.Clinicians undertake the main responsibility of saving the dying and curing the wounded,preventing and treating diseases in health work,which is an important component of improving people’s quality of life,maintaining social equity,and realizing the great "Chinese dream".At the same time,there is no doubt that doctors’ work is risky and stressful,significantly higher than the social average.With the rapid development of medical technology,the public has higher expectations and even demanding of medical effect.However,medicine is full of uncertainty and conflicts between expectations and reality,resulting in more and more doctor-patient disputes.Under the background that medical right has been established as a basic human right,it is self-evident that it is important to improve the legal literacy of clinicians from both the perspective of treating patients and the perspective of self-protection of medical staff.How to let the majority of medical staff know and abide by the law,and at the same time can use legal weapons to protect their own rights and interests,has become an urgent problem in hospital management.Objectives:Study the basic meaning and connotation of legal literacy in theory.By investigating the current situation of clinicians’ legal literacy in five general hospitals in a district of Shanghai.To analyze the problems,possible influencing factors and causes of clinicians’ legal literacy.It provides a scientific basis for putting forward more comprehensive countermeasures with reference value.Methodology:Through literature analysis,this paper compares and analyzes the relevant contents of clinicians’ legal literacy at home and abroad,initially define the concept and basic content of clinicians’ legal literacy.Clinicians’ legal literacy includes legal knowledge,legal awareness and legal ability.According to the "ROCCIPI" theory,these three aspects are divided into seven dimensions: legal rules,legal opportunities,legal capacity,legal exchange,legal interests,legal procedures and legal consciousness.A self-designed questionnaire was used to investigate the clinicians in five general hospitals in a district of Shanghai,collectd data on different demographic characteristics.Understand the current situation of clinicians’ mastery of various laws and regulations,their awareness of abiding by discipline and law and practicing medicine according to law,and their ability to protect their own rights and interests by law from three aspects.There are seven dimensions.This paper analyzes the causes of clinicians’ legal literacy from multiple angles.Analyze and summarize the factors affecting clinicians’ legal literacy.Put forward countermeasures and suggestions to improve clinicians’ legal literacy.Results:(1)Clinicians’ mastery of legal knowledge:Of the 514 clinicians surveyed.A total of298 clinicians answered more than 8 questions correctly,Reached 55.97% of the total number of respondents.The accuracy of medical record writing,prescription dosage and other topics ranked the top two,92.22% and 91.05% respectively.The accuracy rate of "consequences to be borne after illegal application of new medical technology" was the lowest,only 35.02%.(2)Cognition of clinicians’ legal consciousness and ability:The two parts of the survey,if option a in each part is greater than or equal to 4,the respondent is considered to have strong legal awareness or ability.The respondents who met the above conditions were 276(53.69%)and 316(61.48%).Among them,the willingness to "participate in the hospital’s attitude towards organizing lectures on laws and regulations" was the lowest,only 36.77%.(3)There are many factors influencing clinicians’ legal literacy:Including age,degree,professional title,position,working years,self attitude,working status,working atmosphere and training times of the work unit.Conclusions:(1)At the level of legal knowledge:Clinicians have general legal knowledge.This may be related to the low frequency of daily diagnosis and treatment activities and the failure to update the legal knowledge reserve in time.(2)At the level of legal consciousness:Clinicians can realize the importance of legal literacy.However,they will consider whether to use legal means to protect our own rights and interests because of time cost,material cost and other factors.The initiative of learning is general.(3)At the level of legal capacity:There are obvious deficiencies in the ability of clinicians to use law.In real life,when clinicians have disputes,it is difficult to judge and grasp the opportunity of legal application.In addition,it may also be related to the concept of "unwilling to offend people in the workplace".(4)Put forward targeted suggestions from multiple levels according to the influencing factors:To explore the responsibilities to be undertaken from the perspective of clinicians.Discuss the responsibility and role of management from the perspective of hospital.Analyze the power of public opinion and government policy from the social level.And put forward the corresponding specific countermeasures. |
