Research On Liability Risk And Insurance Guarantee Of China’s IP Film

As an important component of the film industry,IP film’s rapid development and huge box office contributions have promoted the international status of China’s film market.In recent years,the number of civil disputes involving IP film has been high,resulting in significant explicit and invisible losses,and the liability risk of IP film is extremely prominent.Therefore,how to identify,evaluate and control the liability risk of IP film in China and design related insurance products is worthy of systematic research from theory to empirical method.This paper sets out the basic theoretical framework of liability risk assessment and insurance research for IP film in China by sorting out related research at home and abroad.Firstly,using judicial big data to analyze the current status of liability risks of IP film,and identify the four main forms of liability risks.Secondly,the judicial case database was used to search and organize and establish a database.Based on the data of 1356 civil disputes of IP film in 31 provinces,municipalities and autonomous regions in China from 2015 to 2019,8 indicators were established using statistical analysis and fuzzy mathematical methods Dimensional IP film responsibility risk assessment model.The empirical results of model index weights show that China ’s IP movie liability risk is mainly concentrated on the risks of intellectual property rights and competition disputes,personality rights disputes.In the secondary indicators,the risks of copyright ownership and infringement disputes and reputation rights disputes account for 52%,These two factors have a more significant impact on the assessment of liability risk.And then apply to the Risk Assessment of China’s IP film J Cases,The result is medium to high risk and verified by facts.Then,this paper puts forward the proposal about rate determination,insurance liability,liability exemption and other provisions for the design of IP film liability insurance product,and designs the risk assessment process of the insurance underwriting business.Finally,based on the research conclusions,this paper focuses on improving the IP film liability risk assessment ability and promoting the development of the IP film liability insurance industry,then puts forward suggestions for the countermeasures of China’s IP film liability risk management.The research methods and results in this article can be used as supplementary research in the field of film liability risk to a certain extent,and have certain reference value for the quantitative evaluation of IP film liability risk and the development of IP film liability insurance business in practice.
