A Study Of Freedom And State Relations In The Critique Of Hegel’s Philosophy Of Law

"Freedom" is a core category in the whole history of western philosophy,and it is the ultimate goal that philosophers have been pursuing all their lives.However,if they want to explore freedom in depth,they cannot do without the understanding of the state,that is,the state is the determination of freedom.Hegel and Marx both have profound views on freedom and the country based on freedom,but their understanding is quite different.Therefore,based on Hegel’s critique of philosophy of law and principles of philosophy of law,this paper takes "freedom" as the starting point to discuss what is freedom and what state can realize real freedom when the country is in,and finally realize the goal of human liberation.Hegel’s premise of exploring freedom is to criticize the present situation of the separation of individual and community,so as to establish a more "scientific" view of freedom.From the perspective of modernity freedom,Hegel’s thought of speculative freedom is undoubtedly progressive.However,Marx believed that Hegel’s thought of freedom can only be realized on the other side,and it is a "heaven" type thought,and the state view based on the thought of freedom only protects the interests of "the property" and realizes the freedom of a few people.Therefore,Marx believed that to eliminate human alienation and national myth,we must abandon the rational thinking mode,eliminate the contradiction between individual and community,establish a new and scientific world outlook on the basis of "practice",and find the real reason.First of all,this paper makes a premise analysis of why Hegel discusses freedom,that is,to clarify the dilemma of modernity freedom,so as to reconstruct Hegel’s thought of the principle of speculative freedom based on the absolute spirit,which provides an important historical premise for Marx to write the critique of Hegel’s philosophy of law.Secondly,it is to sort out the real motivation of Marx ’s writing of Hagel’ s Critique of legal philosophy,to clarify the relationship between Marx and Hagel ’s speculative philosophy,and to criticize Hagel’ s speculative rational thinking mode and the real country based on freedom,so as to break Hagel ’s national myth.Thirdly,it criticizes Hegel’s specific state power system,so as to lay the foundation for seeking real freedom.Finally,by clarifying the differences between Hegel and Marx’s thoughts,we can better understand Marx’s Transcendence of Hegel’s philosophy of consciousness,and thus establish Marx’s philosophy of science,which focuses on real life and guides people to transform themselves and the world.In a word,the research on Hegel’s critique of philosophy of law is endless at home and abroad,which has its rationality and one sidedness.Through in-depth study,analysis and comparison of the literature,this paper can systematically understand the thoughts of Marx and Hegel,understand the grand blueprint of the new world outlook drawn by Marx,and safeguard the scientificity of Marxism.
