The Research Of Illicit Sex Between Relatives In Song Dynasty

Since ancient times,sex has been an unavoidable problem in human history.In ancient China,the legislation on sex experienced a process from simple and rough to comprehensive and detailed.As a special sexual crime,illicit sex between relatives are restricted by law and morality.On the whole,the Song Dynasty fully inherited the provisions of the Tang Dynasty on illicit sex between relatives,and made corresponding changes in order to adapt to the development and changes of society,such as the expansion of the scope of legislation.This paper studies the illicit sex between relatives in Song Dynasty mainly from the legal and social perspectives.Firstly,it deeply interprets the legal provisions and judicial practice of the illicit sex between relatives in Song Dynasty.Taking the illicit sex between relatives’ law as the breakthrough point,it discusses the laws and characteristics of the illicit sex between relatives in Song Dynasty,and studies the cases of the illicit sex between relatives in Song Dynasty,This paper summarizes the main types and judicial characteristics of illicit sex between relatives’ cases in Song Dynasty.Secondly,from the social environment of the Song Dynasty,such as social tolerance,social atmosphere and other aspects to explore the influence of the illicit sex between relatives.This is because Neo Confucianism,which was born under the influence of Confucianism in Song Dynasty,has higher and higher requirements for morality and ethics.Therefore,it is not only based on the results of cases to study the illicit sex between relatives,but also from the perspective of officials and the parties to the case to analyze the social attitude of the Song Dynasty towards the illicit sex between relatives.Finally,the Song Dynasty illicit sex between relatives’ law and the yuan,Ming,Qing Dynasties to the new China period were compared,thus reflecting the Song Dynasty illicit sex between relatives’ legislation and sentencing with moderate,light and simple,humane and other characteristics,and through comparative analysis,summed up the deep reasons for the evolution of legislation after the song Dynasty,I believe that for today’s society how to face and solve this problem has a certain practical significance.
