| Intellectual property is not only the guarantee of innovation,but also the primary engine for development.With disputes of trademark,copyright and patent becoming common issues in modern society,intellectual property cases are arousing growing concerns from the public.Based on this background,this report takes Intellectual Property Examples and Explanation as the translation material.This book is a textbook for law school students in the US.It covers a variety of real-life intellectual property cases,which are aimed to help readers master relevant legal knowledge.The text presents corresponding intellectual property cases in a concise language style and elucidates the relevant legal knowledge to readers via a variety of examples.The author of this report chooses the first chapter of this book,COPYRIGHT,as the translation object in an attempt to explore various problems in the translation process of legal text.Based on the CEA framework of “Comprehension,Expression and Adaptation”proposed by Professor Li Changshuan,this report attempts to discuss the translation problems in legal text from three aspects.As for “comprehension”,the author comprehends the source text via the Internet and text context;As for “expression”,the author analyzes the expression of translation via standardizing the citation expression,verifying the terminology,analyzing the long and difficult sentences and clarifying the connotation of pronouns;As for “adaptation”,the author modifies the language through amplification and omission as well as word order adjustment in translation.On the basis of fidelity to the source text,the author of this report classifies the problems related to the accuracy of translation into the comprehension category;summarizes the problems related to the fluency of language into the expression category;and classifies the problems related to the translating technique of amplification,omission and processing of original information into the adaptation category.The background of the translation practice,the current status of legal translation studies,the description of translation process which is guided by the CEA framework,as well as the glossary are covered in this report.The core of this report is the description of translation process.In order to solve the non-equivalence of legal terms in different language backgrounds,translators are supposed to have a full comprehension of the relevant legal knowledge,and standardize the corresponding translation.As for long sentences and common pronouns,translators need to analyze carefully,in order to avoid ambiguity.The author summarizes the translation skills of legal quotation,professional terms,compound clauses and pronouns,hoping to provide useful references for legal translators. |
