An Analysis Of The Legal Liability System For Administrative Monopoly Behavior

Under the rule of law required by the report of the 19 th National Congress to break administrative monopolies and regulate government power,the abuse of administrative power by administrative organs and the elimination and restriction of competition have again attracted great attention from the legal circles.However,the crackdown has been ineffective,and administrative monopolies have repeatedly banned.One of the more important reasons is that China's current legal liability attribution system for administrative monopolies is incomplete and incomplete.China's "Anti-Monopoly Law" has few legal liability attribution systems for administrative monopoly,and there are a series of institutional problems such as unclear responsibility and vacancy of responsibility for the design of the legal responsibility attribution of administrative monopoly implementation subjects,it is not enough to adequately determine and blame the illegal subjects of administrative monopoly,and it is difficult to achieve deterrence and regulation of illegal acts of administrative monopoly.Therefore,the establishment of a sound legal responsibility system for administrative monopoly violations is currently the most urgent task in our country,and further research and analysis of the administrative monopoly responsibility system is needed.This article focuses on the construction and improvement of the administrative monopoly legal responsibility attribution system,and analyzes China's current system defects and practical dilemmas.Drawing on the relevant successful experiences of foreign countries,we have designed a relatively complete legal responsibility attribution system that is in line with China's institutional design,and give full play to the decisive role of the judiciary in regulating administrative monopoly and implementing legal responsibility.System,strengthen the responsibility and legal regulation of China 's administrative monopoly behavior,and achieve the ultimate goal of creating a benign market competition environment.
