Research On Ecological Restoration Responsibility System Of Natural Protection

The construction of nature reserve system is a n important part of the construction of ecological civilization system,which is of great significance to promote the scientific protection and rational use of natural resources.In the earl y construction of nature reserves,the failure to balance the rela tionship between conservation and development has caused a large number of ecological and environmental problems,and problems such as ecosystem degradation are becoming more and more promin ent,so it is urgent to improve the ecological restoration respons ibility system of nature reserves.This paper uses the literature research method,comparative research method and empirical analysis method to explore the nature of ecological restoration l iability of nature reserves from the concept of ecological restora tion liability of nature reserves,and concludes that ecological restoration liability of nature reserves is not limited to a single legal nature,but also has the nature of civil and admini strative liability.Through combing the legislative overview and j udicial practice of ecological restoration liability of nature reserves,we analyze the problems of imperfect legal system,single main body of restoration liability,unreasonable restoratio n standard,insufficient investment and management of restoration funds,and unsystematic supervision of ecological restoration.The ecological restoration system of the United States is selected as the object of comparative study,and the liability system for restoration of polluted land,the liability system for restor ation of brownfield sites,the natural resource damage assessment system and the ecological restoration investment and financing mechanism are specifically examined to draw inspiration for t he ecological restoration liability system of nature reserves in C hina.Combining with the actual nature reserves in China,we theoretically propose to improve the legislative system of ecological restoration responsibility of nature reserves,introduce the basic law of Nature Reserve Law,formulate the Regulations on Restoration of Nature Reserves,and construct a specific system of ecological restoration responsibility,including clarifying the main body of ecological restoration responsibility,formulating scientific and reasonable restoration standards,regulating the way of ecological restoration responsibility assumption,and establishing the nature reserve ecological restoration The fund and supervision system.Improving the ecological restoration responsibility system of nature reserves is not only necessary for the practice of ecological restoration of nature reserves,but also for the construction of the legal system of ecological restoration in China,which is the way to the rule of law of ecological civilization.
