Research On Regional Cooperative Legislation Of Grand Canal(Jiangsu Section)Protection

The Grand Canal is a precious cultural treasure left by our ancestors.In the course of more than two thousand years of dredging,construction,maintenance and use,canals have nurtured valuable cultural heritages in the cities through which they flow.To protect and make good use of the Grand Canal is an important task for us in the future.Considering the integrity and fluidity of the Grand Canal,various coastal cities should carry out cross-regional collaborative legislation to effectively protect the Jiangsu section of the Grand Canal on the basis of consultation and co-governance.This paper firstly defines the concept of regional cooperative legislation,and summarizes the main characteristics of regional cooperative legislation in three aspects:legislative subject,legislative behavior and protection object.Then,this paper introduces the conditions and background of the implementation of cross-regional collaborative legislation in Jiangsu section of the Grand Canal,mainly from the four aspects of the natural geographical attributes of the Grand Canal,the current protection status,the legislation status,and the significance of the Grand Canal,in order to illustrate the feasibility of the current implementation of the Grand Canal collaborative legislation protection.Then,this paper further explains the current difficulties in the collaborative legislation of the Grand Canal,including the following aspects.Firstly,the legality of regional cooperative legislation has not been confirmed;Secondly,there are many operational problems in regional cooperative legislation,including vague legislative subjects,unclear legislative authority,and local protection considerations in legislation.Thirdly,the regional cooperative legislation also lacks the corresponding guarantee mechanism.It is manifested in the lack of coercive force of administrative agreement and the lack of public participation.Finally,the paper enumerates some successful legislative practices both within and outside the region,and draws lessons from their experiences,and puts forward some suggestions on constructing the cooperative legislative mechanism of Grand Canal protection in our country from the aspects of legislative principle,legislative subject and authority,cooperative mode and protection mechanism,etc.That is to clarify the principle of collaborative legislation in the Grand Canal and provide guidance for the practice of collaborative legislation.As the main body of legislation,we adhered to the dominant position of the NPC and carried out coordinated legislation within the scope authorized by laws and regulations.As the main body of legislation,we adhered to the dominant position of the NPC and carried out coordinated legislation within the scope authorized by laws and regulations.In this regard,it is suggested to adopt a regular joint meeting mechanism and set up a deliberative and coordinating body responsible for convening,so as to provide a platform for collaborative legislation.At the same time,for the collaborative results,it is necessary to give its legal force to ensure the smooth implementation of the results.In addition,we need to pay attention to the participation of the public and the cooperation of universities in the process of collaborative legislation,listen to the opinions of the public,give play to the advantages of think tanks,and strive to improve the quality of legislation.
