With the extensive publicity of the concept of green development and the construction of ecological civilization in recent years,the social responsibility of enterprises has become a hot topic of the times,in which the environmental damage responsibility of enterprises also occupies an important position in the environmental legal system.In recent years,with the rise of public interest litigation and the continuous improvement of the ecological environment damage responsibility system,enterprises pollute the environment in the process of production Bad ecology may lead to huge or even sky high cost of environmental damage repair.As a special form of enterprise,whether financial institutions should bear the same environmental damage liability as enterprises is also worth exploring.However,the environmental damage liability system of commercial banks in China is still in the blank.Although it is involved in some legal provisions,it is generally lack of binding legal provisions and focuses on personal property compensation rather than ecological environment compensation.However,it has become a general trend that Chinese commercial banks’ lenders will bear the responsibility for environmental damage.In order to better solve environmental problems,improve China’s eco-environmental damage liability system,and reduce the potential risk factors caused by environmental damage liability of commercial bank lenders,this paper,from the perspective of environmental damage liability of commercial bank lenders,explores the differences between environmental tort liability and environmental damage liability of commercial bank lenders,and draws lessons from commercial banks such as the United States and the United Kingdom Based on the experience of environmental damage liability of commercial bank lenders,combined with the theoretical basis of environmental law of commercial bank lenders,this paper puts forward some suggestions on the environmental damage liability system of commercial bank lenders in China.
