Study On The Legal Protection Of Ecological Compensation Standards In China’s

With China’s rapid economic and social development,people’s needs for production and livelihood are increasing,and huge economic benefits have been achieved through the exploitation and use of watershed ecological resources.At the same time,however,the ecological resources in the watersheds have been excessively depleted and the ecosystems in the watersheds have been severely damaged,resulting in a serious ecological crisis.Watershed ecological compensation is an effective means to compensate for the damage caused by destructive human activities and to restore and balance the watershed ecosystem.In watershed ecological compensation,the compensation standard is the core measure reflecting the relationship between the interests of various subjects in the watershed.A scientific,reasonable and effective compensation standard plays a crucial role in determining the subjects to be compensated,selecting the compensation method and implementing the compensation responsibility mechanism.However,China lacks a clear and systematic legal regulation of watershed ecological compensation standards,and the regions within the watershed also lack some scientific methods to measure the compensation standards as a basis.The purpose of this paper is to sort out,analyse and select the accounting methods of watershed ecological compensation standards,compare and analyse typical samples at home and abroad,conclusion the current situation and shortcomings of China’s watershed ecological compensation standards from both vertical and horizontal aspects,attempt to construct a scientific and reasonable system of watershed ecological compensation standards,and then propose countermeasures to improve the legal protection of China’s watershed ecological compensation standards.
