Research On Legal Problems And Countermeasures Of Environmental Protection In Chishui River

With the rapid economic development,the blind pursuit of economic benefits has caused great damage to the ecological environment of Chishui River basin.The Chishui River is an important tributary of the upper reaches of the Yangtze River and the only river without DAMS.The upstream region of the Yangtze River is a very important ecological protection zone bearing important ecological development responsibilities.As an important direct current of the Yangtze River Basin,the Chishui River Basin has been rich in wild animals and plants since ancient times,such as the famous bamboo sea and Chishui tree ferns.The Chishui River Basin is famous for its fine wine,beautiful scenery and delicious food.Especially,the wine industry culture such as Maotai and Xijiu,which are famous in the world,are closely related to the Chishui River.Thus Chishui River has very important ecological environment protection value and cultural protection value in our country.However,since the Chishui River flows through three provinces and many cities,administrative law enforcement has overlapping functions and the lack of top-level design at the legislative level,which undoubtedly increases the difficulty of legal protection of the Chishui River basin environment.The sustainable development of environmental protection in Chishui River needs to strengthen the legal guarantee of legislation,law enforcement,judicial and law-abiding,and balance economic development,social development and environmental protection from the top-level design level,so as to realize the organic unity of ecological,economic and social sustainable development.At present,environmental protection in the Chishui River Basin mainly presents regional protection with separate blocks and separate governance,and no systematic legislative protection has been carried out at the national macro level.Therefore,it is difficult to deal with the current problems of environmental protection in the Chishui River,such as the difficulty of law enforcement,the lack of law enforcement authority,and the practical protection dilemma of the weak ability of cross-regional collaborative protection in judicial practice.Further analysis of the reasons are mainly due to the lack of special legislation of legal protection in the Chishui River Basin,weak environmental law enforcement and protection,environmental judicial protection,low illegal cost of citizens’ environmental damage and insufficient incentive mechanism.Based on this,this paper adopts the methods of literature analysis,comparative analysis and historical analysis,after comparing and analyzing the empirical measures of river basin protection in foreign countries,aiming at the specific causes of the current problems in the Chishui River basin,and combining with the viewpoints of domestic scholars,puts forward the comprehensive measures of environmental legal protection in the Chishui River basin.Specifically,the legislation should comprehensively consider the various elements of the Chishui River ecosystem,promote the formulation of comprehensive laws from the top-level design level,construct the environmental protection mechanism of the Chishui River basin to promote inter-regional linkage between departments,break the deadlock of "Kowloon water control",explore the establishment of ecological environment supervision and administrative law enforcement agencies of the Chishui River,and establish the ecological compensation mechanism of the Chishui River.Strengthen cross-provincial checks on law enforcement,unify law enforcement standards,law enforcement procedures and law enforcement monitoring,and strengthen responsibility assessment and supervision mechanisms;In terms of judicature,we should improve the specialization of the judicial institutions in Chishui River,explore the adjustment and completion of the main body,content and form of public interest litigation in Chishui River basin,and increase the severity of punishment for water resources damage.In terms of abiding by the law,the publicity of the law should be strengthened,citizens should be enhanced to participate in the water environmental protection work of Chishui River,citizens should be called upon to improve their environmental protection literacy,emphasize water-saving in life,and formulate an incentive water-saving control system.Through the careful design of a series of legal links,and finally through the systematic linkage of legislation,law enforcement,justice and law-abiding,a three-dimensional legal mechanism for environmental protection of Chishui River has been formed.
