The red line system of ecological protection is a conceptual innovation and institutional innovation in the field of ecological space protection in China,and it is a legal practice of comprehensive ecosystem theory and land space planning theory.After four development periods,the red line system has played a significant role in ecological space protection,but there are still some problems,such as incomplete coverage of the existing legislation in each region that has been classified into the red line of ecological protection,vague central legislative provisions,etc.The Measures for the Administration of the Red Line of Ecological Protection issued by the Ministry of Natural Resources cannot coordinate the legislation in the red line because of its low level of effectiveness.The existing red line demarcation method is unscientific,and the demarcation process ignores the connection with other control lines;The internal supervision responsibility of the red line area is not clear,and the zoning management mode with the core area of the nature reserve as the boundary is unreasonable;The existing accountability mechanism does not highlight the protection of ecological legal interests,and the public participation mechanism and compensation mechanism for ecological protection are not perfect.It is necessary to improve the unified legislative orientation of the ecological protection red line,improve the legislative system by implementing the central regulations in detail by local legislation,improve the red line delineation method from the perspective of land and space planning,and coordinate the overlapping parts of the red line boundary;Determine the red line supervision department with the principle of "proper function" and practice the three-zone classification control measures;Legal accountability should highlight the protection of ecological security interests and improve ecological protection.
