As the source of the Pearl River,the third largest river in China,the the Pearl River Source Nature Reserve has extremely important ecological value.In addition to playing an important role in preventing water and soil damage and maintaining regional ecological stability,its huge water storage and air purification capacity has effectively guaranteed the normal operation of the city and improved the urban air quality.It is of great significance to protect the rich and precious natural resources of animals and plants in the the Pearl River Source Nature Reserve for biodiversity conservation and related scientific research in China.What does not match with its significant ecological value is that the existing laws and regulations are difficult to provide guidance for the ecological protection of the Pearl River Source Nature Reserve that is more consistent with the development and protection of the Reserve,and even hinder the ecological protection of the Pearl River Source Nature Reserve.Formulating special laws and regulations to promote scientific and orderly development of ecological protection in the Pearl River Source Nature Reserve,in order to realize its ecological value,is of great importance to the needs of the Reserve itself.Based on this situation,this paper,from the perspective of scientific legislation and legislation according to law,adheres to the concept of environmental protection and harmonious coexistence of man and nature,conducts a systematic study on the legislative issues of the Pearl River Source Nature Reserve,and seeks for existing problems and solutions.This paper begins by elucidating the research background and importance of the paper,followed by an examination of the research standing of nature reserves both domestically and internationally,and finally,the research content and methods of this paper.The first chapter discusses the legislative status of the pearl river source nature reserve.First of all,the concept of the nature reserve is analyzed.After a clear understanding of the nature reserve,the basic situation of the Pearl River Source Nature Reserve is investigated in detail,and the relevant legislation of the Pearl River Source Nature Reserve is sorted out,providing a legal basis for the later research on the legislation of the Pearl River Source Nature Reserve.The second chapter analyzes the legislative problems and conditions of the Pearl River Source Nature Reserve.Based on the analysis of the reality of the natural protection of the source of the Pearl River and the existing legal system,the legislative problems in the source of the Pearl River Nature Reserve are summarized to determine the focus for legislation.After that,the necessity and feasibility of the legislation of the Pearl River Source Nature Reserve are studied and demonstrated to ensure the practical research value and operability of the paper.The third chapter studies the management and legislation of nature reserves abroad.In combination with the problems existing in the Pearl River Source Nature Reserve,we will specifically learn from the management and legislative experience of foreign nature reserves for reference in the management and construction of the Pearl River Source Nature Reserve.The fourth chapter puts forward the legislative conception of the Pearl River Source Nature Reserve.Five components comprise the content: the formulation and expansion of the legislative form,the intent and fundamental principles of the law,the formation of the main material,the composition of the text structure,and other related matters,like legislative quality assurance measures,as well as the evaluation of the socio-economic effect of the law.The article’s research revealed that the laws governing the Pearl River Source Nature Reserve’s development and construction are not taking into account its integrity,the management organization’s system is far from perfect,the management mode is single,public involvement is difficult,there is no ecological compensation mechanism,and the resource utilization management system is far from ideal.The Pearl River Source Nature Reserve was established through legislative construction,which included a thorough recognition of the purpose,fundamental principles,and other related matters.this paper focuses on the existing problems,actively seeks effective systems and measures,and puts forward corresponding legislative suggestions,with a view to promoting the scientific development of ecological protection in the Pearl River Source Nature Reserve.
