Research On Legal Issues Of Horizontal Ecological Protection Compensation In The Yellow River Basin

With the continuous development of the whole process,every aspect and every link of the society,the horizontal ecological protection compensation in the Yellow River Basin plays an increasingly important role in the historical background of enhancing the construction of ecological civilization.However,previous studies on horizontal ecological protection compensation mainly focused on the Yangtze River and Xin’anjiang River basins,while the amount of horizontal ecological protection compensation in the Yellow River Basin to be studied in this paper is very small,and the research content is limited to a single discipline and an individual region.Horizontal ecological protection compensation in the Yellow River Basin is a systematic and complex project.It is not only necessary to make good use of the knowledge of environmental and resource protection law,ecology,statistics and other disciplines,but also to further integrate ecological protection compensation with institutional innovation.To promote the legal,diversified and market-oriented construction of horizontal ecological protection compensation in the Yellow River Basin,so as to form a deeper and three-dimensional development pattern.According to the above characteristics of horizontal ecological protection compensation in the Yellow River Basin,this paper is divided into four chapters to discuss in detail:In Chapter 1,by sorting out related concepts,the author analyzes the academic circle’s views on the two concepts of ecological protection compensation and watershed horizontal ecological protection compensation,and finds that scholars have not yet formed a unified view on the concept of watershed horizontal ecological protection compensation.Secondly,the paper analyzes the four basic theories of horizontal ecological protection compensation in the Yellow River Basin.Finally,the necessity of horizontal ecological protection compensation in the Yellow River Basin is analyzed,which lays a theoretical foundation for the research on the legal issues of horizontal ecological protection compensation in the Yellow River Basin.The second chapter analyzes the general characteristics of the current horizontal ecological protection compensation practice in the domestic basin,focuses on the selected practice patterns of Dawen River basin,Gansu and Sichuan,Henan and Shandong horizontal ecological protection compensation,summarizes the current practice predicament of the Yellow River basin to carry out horizontal ecological protection compensation: There are no specific laws,insufficient coordination in compensation work,unitary compensation model,and weak administrative supervision.Make the countermeasures more targeted.The third chapter is based on the practice of ecological protection compensation outside the region,through the analysis of the horizontal ecological protection compensation in the Elbe River basin,Kazkels River basin and Lake Biwa River basin,and puts forward the reference system enlightenment for the Yellow River basin.It provides reference for improving the compensation mechanism of horizontal ecological protection in the Yellow River Basin.Based on my own research and analysis,the fourth chapter adopts a problem-oriented approach,starting from the establishment and improvement of relevant legal systems,running through the institutional framework of horizontal ecological protection compensation,and finally through the establishment of long-term management system,jointly constitute the horizontal ecological protection compensation mechanism of the Yellow River Basin.
