Research On The Leagl Protection Of Poyang Lake Wetland Safety

Poyang Lake wetland is an important ecological barrier of the Yangtze River and a world famous natural wetland,with important ecological security functions.The internal requirements of ecological security of Poyang Lake are to ensure that the ecological resource carrying capacity of Poyang Lake is in a sustainable and stable state,to maintain the adaptability of wetland ecology to sustainable economic and social development,and to ensure that the prevention,control,and resolution of ecological risks of Poyang Lake wetlands are in good condition.In recent years,the Poyang Lake wetland ecology has received great attention from the state and local governments,but its ecological security still faces such practical challenges as the decline of resource carrying capacity,weak adaptability to economic and social development,national prevention and control of ecological risks and improvement space.Today,national security is increasingly valued,and it has become a very urgent practical problem to respond to the ecological security challenges of Poyang Lake by legal means.This paper focuses on the practice and problems of legislation,law enforcement and judicial protection of Poyang Lake wetland ecological security.The study found that there are many problems in the legal protection of Poyang Lake wetland ecological security: first,at the legislative level,there are problems such as insufficient highlighting of legislative ideas,insufficient pertinence of legislative norms,and difficult to effectively play the detailed and supplementary functions of policy provisions;Second,at the law enforcement level,there are still shortcomings such as insufficient authority of the law enforcement subject,obvious phenomenon of multiple management,blind spots in law enforcement,and incomplete law enforcement responsibility mechanisms;Third,at the judicial level,there are also problems such as difficulties in initiating judicial procedures,insufficient judicial protection,and insufficient connection between justice and law enforcement.In response to these problems,the following suggestions are put forward: First,at the legislative level,we should further strengthen the concept of ecological priority legislation,improve the local legal system with wetland local laws and regulations as the core,and strictly enforce the approval system for wetland expropriation and occupation,so as to provide a strong legal support for the formation of a long-term mechanism for ecological safety protection of Poyang Lake wetlands.Second,at the law enforcement level,we should further strengthen the Poyang Lake law enforcement team and capacity building,improve the law enforcement linkage mechanism,build horizontal cooperation and vertical linkage law enforcement,and strictly enforce the law enforcement supervision mechanism.Third,at the judicial level,it is proposed to establish the concept of judicial protection of wetlands,expand the scope of litigation subjects,strengthen the construction of environmental judges and strengthen the judicial law enforcement linkage,so as to provide judicial protection for effectively reducing the environmental damage of Poyang Lake wetland ecology.Through the above legal measures,the ecological security of Poyang Lake will be guaranteed and Poyang Lake will provide more sustainable ecological resources for human beings.
