Research On The Improvement Of New Psychoactive Substance Control Measures

New psychoactive substances(NPS)are substances of abuse which are not controlled by the single Convention on Narcotic Drugs of 1961 or the Convention on Psychotropic Substances of 1971 but which may endanger public health.They are both addictive like drugs and unregulated.In the past few years,the types and abuse of new psychoactive substances have proliferated at an unprecedented rate,causing great confusion to law enforcement authorities in their fight against criminal acts.In China,the main legal basis for the control of new psychoactive substances is the Measures for the Listing of Non-medicinal Narcotic Drugs and Psychotropic Substances.The control system formed by the national Narcotics Control Office leading the decision-making of the Public security department of The State Council,the food and drug supervision and administration department,the health and family planning administrative department,and the implementation of provincial and municipal narcotics control offices and relevant departments(there is no law authorizing the provinces to formulate control measures)is increasingly not adapted to the current situation of the evolution of China’s drug situation.To strengthen the control of new psychoactive substances and to formulate and perfect the control measures of new psychoactive substances in order to better adapt to the control of new psychoactive substances in China has become a very urgent public safety management problem,which urgently needs theoretical research and practical exploration.This study active material in the spirit of the new regulation as the research object,anchor construction in the new period our country active substances control measures to perfect the new spirit,with institutional change theory,governance theory,safety management theory as the theoretical basis,the integrated use of literature research,research methods,such as visiting survey method,new spirit in sorting out the related concepts,analysis of the current active material control in our country,Combined with the empirical analysis of F province,this paper deeply analyzes the existing problems and causes of NPS control measures in China,and draws on the international experience of NPS control measures to study and put forward relevant suggestions for improving control measures.In this study,the main problems of NPS control measures in China are unclear rights and responsibilities of NPS control subjects,inadequate timeliness of NPS control,and lack of hardware and talent support.In order to further improve the control measures of new psychoactive substances,it is suggested that Office of national Narcotics Control Commission should be defined as the temporary regulatory and decision-making body,the network early warning system of new psychoactive substances should be established under the new situation,and the basic hardware of early warning and monitoring should be strengthened,such as drug experiments,to consummate the new spirit of active substances control measures.
