A Report On Chinese-english Translation Of Essentials Of Intellectual Property: Institutional Innovation And Knowledge Innovation (Chapter Two)

The translation task selects from the chapter “IPRs as Private Rights: its Legal Form,Values,and Social Roles” from the book Essentials of Intellectual Property:Institutional Innovation and Knowledge Innovation,as a real Chinese-English translation task.The source text(ST)introduces basic attributes and functions of intellectual property rights from multiple levels,which has made a contribution to promoting the research in the field of intellectual property in China.The translator hopes to convey “China’s voice” on the international IPRs stage through the translation version.According to Christiane Nord’s text analysis,the translator analyzes the original text from two perspectives: extratextual and intratextual.Text function of the translation task from extratextual factors focuses on the message transmission and dissemination.From the perspective of intratextual factors,ST is presented in a logical and chronological sequence in accord with English legal writing features.However,there are also sentences that do not conform to academic writing norms,such as loose sentences,sentences without subjects,and sentences with long attributes,which suggest that translators need to pay attention to such sentences.In addition,how to translate legal terms,economic terms,and culture-loaded terms without official translation versions also causes translation difficulties.Under the guidance of translation memetics and Chinese scholar He Ziran’s perspectives,three ways are summarized to code ST into strong memes in order to facilitate the dissemination of memes: associating with a strong meme of content,associating with a strong meme of form,and associating with a strong meme of academic legal writing features.The first two ways can address translation of legal and economic terms as well as culture-loaded words,while associating with a strong meme of academic legal writing features can address translation at the syntactic level such as loose sentences,sentences without subject,and so on.Through case analysis,translation memetics effectively guides the whole translation process,which can ensure not only that the target text(TT)conveys the original author’s intention,but that TT is strong memes to be replicated and transmitted more effectively.Finally,the translator hopes that this translation report can help the translator herself and other translators comprehend how to finish a complete translation task and translate related translation projects in the future.
