| The marriage system in modern times has always been in the midst of the changes between the traditional and the modern.Under the collision of old and new ideas,the marriage law has also shown a change from family-based to individual-based.As a special kind of marriage,military marriage is not only influenced by modern marriage,but also more complex and special because of the national interests behind it.The particularity of military marriage is mainly reflected in two points: First,the particularity of the military group.Second,the complexity of wartime society.Soldiers,as the main force of the national revolution,shoulder the heavy responsibility of defending their families and the country.Their marriages and families are also under the discipline of the national revolutionary discourse,and everything serves the war.In addition,the multiple forces of the Kuomintang,the Communist Party,and the Japanese and puppets in Hubei during the war were entrenched,and the political situation was complicated,which also added obstacles to the operation of the military marriage system.So what kind of system is the military marriage system? How did this system work in Hubei society during the war? How are military marriage disputes handled? What is the fate of female military relatives as wives in military marriages? This is what the author thinks about.In the past,academic research on marriage and family mainly focused on marital disputes such as bigamy and divorce,paying more attention to ordinary women in urban and rural areas,and less attention to military spouses.Even if we pay attention to military marriage,we mostly start from the CCP’s marriage reform.From the perspective of men,we believe that the military marriage guarantee system is conducive to stabilizing the military’s morale and encourages soldiers to fight against war,ignoring the equal rights that anti-families(mostly women)should enjoy in marriage.The significance of this paper is to re-examine the military marriage system from the perspective of war and women,emphasizing that the military marriage system is a product of revolution,but women’s rights should not be ignored.Through the collection,integration and utilization of a large number of unpublished military marriage judicial files,supplemented by newspaper materials,and adopting an interdisciplinary research method,this paper analyzes the practical dilemma of the official military marriage system in the grassroots society in the turbulent era,in order to promote the further development of related research.In general,this article not only studies the general situation of military marriage in Hubei in the later period of the Republic of China,but also focuses on judicial practice and women’s rights under military marriage disputes.Following the research idea of combining legal text and judicial practice emphasized by Huang Zongzhi,the use of judicial archives to further explore the predicament of women’s existence is a dynamic study of legal social history. |
