| The promulgation and implementation of Chinese Civil Code is an important symbol of the new height of the socialist legal system with Chinese characteristics and a major milestone.As the basic law in force in China at this stage,Chinese Civil Code not only conveys the spirit of the rule of law in China in the new era,but also expresses the national spirit of China.Quality legal translation promotes the construction of rule of law civilisation,among which legal terminology translation is the focus and hot spot of legal translation research.The practical work of translation is summarised and raised to the theoretical level to better guide future translation work.This thesis takes Chinese Civil Code and its Uyghur translation as the data to conduct a theoretical summary and analysis of the translation of legal terms.The thesis is divided into six parts.The first part is the introduction of this study,including the research questions,research objects,and research methods of the thesis.It discusses the purpose and significance of conducting research on the translation of legal terms,compares the overview of research on legal terms and their translation at home and abroad,and reveals the research significance and academic value of the thesis.Chapter 1 explores the characteristics and classification of legal terms from the definition of legal terms.This paper concludes that legal terms have six general characteristics: specialisation,exclusivity,analogy,renewal,stability and inheritance.On the basis of the legal significance of legal terms and the strength of the denotative function of legal concepts,legal terms are divided into four categories: specialised legal terms,exclusive specialised legal terms,generic legal terms,and innovative and borrowed legal terms.Finally,the uniqueness of the legal terminology of Chinese Civil Code are explored.Chapter 2 discusses the translation standards and translation principles of legal terms,and argues that the translation of legal terms should abide by the standard of faithfulness and follow the principles of accuracy,conciseness,consistency and professionalism.Chapter 3 takes the legal terms in Chinese Civil Code as an example to explore the translation theoretical principles followed by translators in translating under language differences and explores the translation methods adopted for different categories of legal terms.Analysis of the data reveals that the choice of translation method depends on the degree of lexical equivalence in the two languages.And the translation of legal terms in Chinese Civil Code conforms to three cases: basic equivalence,partial equivalence and non-equivalence.When the vocabulary of the original language and the translated language are largely equivalent,the direct translation method can be used directly.In the case of partial equivalence,the translation method is more flexible and direct translation and paraphrasing can be chosen to ensure that the correct legal connotation is conveyed.When there is no equivalence,the interpretive method is often used to ensure that the legal connotation is accurate,and the term is translated interpretively.Based on the analysis,it was concluded that the translation of the legal terms of Chinese Civil Code complies with the standards and principles of translation.Chapter 4 discusses the highlights and problems found in the translation of legal terms in Chinese Civil Code,makes a preliminary analysis of the causes of these problems,and puts forward suggestions for improvement on the basis of exploring the basic requirements for the translation of legal terms in Chinese Civil Code: taking accuracy as the first principle,combining conventions with annotations,and developing uniform reference standards.The aim is to guide the practice of translating legal terms into Uyghur.The final section is a conclusion,which summarises the main points of the paper and points out the shortcomings of the paper and indicates the direction for further research. |
