Research On Intellectual Property Protection Of Intangible Cultural Heritage Industrializatio

China’s intangible cultural heritage is huge and diverse,and has typical regional characteristics.With the progress of modern society and the development of digital technology,ICH,which is a symbol of excellent traditional culture,has been forgotten by people.Although China has introduced laws and regulations to protect ICH administratively,such a passive approach cannot fundamentally solve the problem of ICH protection and development.The industrial development of NRM can solve this problem at the source.Industrial development of NRM brings NRM into the market environment,which not only can stimulate the endogenous power of NRM and turn passivity into initiative,but also can obtain considerable economic benefits through market operation and realize the economic value of NRM.Under the background of building a strong cultural country,the revitalization of NRM cultural industry has become an inevitable trend.However,in the process of marketization of NRMs,attention needs to be paid to problems such as misappropriation of NRM contents.Intellectual property,as an effective way to protect the fruits of human intellectual labor,is the best choice to solve this problem.But whether there are problems in its real application process needs to be explored.Yunnan,as one of the provinces with the largest number of ethnic elements and the richest variety and quantity of non-heritage in China.Its non-heritage industry is developing rapidly,and it is one of the representative provinces for the industrialization of non-heritage,and it has also achieved more remarkable results in the protection of intellectual property rights in the industrialization of non-heritage.In this paper,we search and organize the data of intellectual property rights of non-heritage industry in China and Yunnan,and analyze and study the data according to three types of intellectual property rights:patent,trademark and copyright.The paper also analyzes the successes and problems in the protection of intellectual property rights by selecting representative cases of industrialization of non-heritage in Yunnan in the fields of traditional handicrafts,traditional food and traditional medicine,and then summarizes the problems in the protection of intellectual property rights and proposes targeted countermeasures.This paper is mainly divided into the following parts.Firstly,the theories related to the concept of non-heritage,the concept of industrialization of non-heritage,and the concept of intellectual property rights of industrialization of non-heritage are explained.Secondly,by searching and collecting the data of patents,trademarks and copyrights related to non-heritage in China and Yunnan non-heritage industry,and conducting quantitative statistics and research according to the effective situation,classification situation,operation situation and industrial field situation,the current situation of intellectual property protection in non-heritage industry is summarized.Then,we select representative cases of industrialization of non-heritage in three fields of Yunnan traditional handicrafts,traditional food and traditional medicine,search and study their patent,trademark and copyright data,and analyze their successful experiences and problems in intellectual property protection.Finally,based on the results of the above-mentioned IPR protection status and case analysis of China and Yunnan non-heritage industries,the problems in IPR protection of industrialized non-heritage are summarized,and specific suggestions are made in terms of IPR legal system,IPR operation and IPR management.
