The Analysis On The Theory And Practice Of The Management Of The Sea Area Usage

Ocean is the basic component part of the global life supporting system and the precious wealth of realizing the sustainable development of human being. For centuries, Ocean has occupied an important position in the evolution of human being and the economic development of human society. With the promotion of the industrialization tide in the scope of the world and the rapid development of new scientific technology, ocean has become more and more valuable to the economic development of human society and ocean economy has become the economic domain that occupies the important strategic position. The sea area is the platform of developing ocean economy and exploiting ocean resources. China is a country that has a large area of territorial waters full of precious ocean resources. But in such a vast valuable blue land, because of the vague state of property rights over a long period, the phenomena of using the sea area resources excessively, freely or out of order occurred constantly, which caused large loss of state-owned resources and affected the performance of the comprehensive benefits of the sea area and the sustainable development of ocean economy. In order to settle the problems of the sea area usage and ensure the healthy development of ocean economy, the management of the sea area usage provides a new thinking route from the theoretical and practical views. is the basic law related to the management of the sea area usage in our country. Although it has included all the main issues of the management of the sea area usage, it just provides a law platform of the management of the sea area usage from the aspect of law. In view of the fact that the theory of the management of the sea area usage has lagged behind the practice over a long period, the systematic deep research of the management of the sea area is in an urgent need. As far as the accomplishments of domestic scholars and experts are concerned, most researches are carried out from the aspects of law and policy. And there are few researches on the property rights of the sea area resources by applying the theory of property rights of new institution economics. Therefore, the research of the management of the sea area usage from an economics view will fill the gap in the theoretical research of the management of the sea area usage and be an innovation in theory.The thesis is composed of seven chapters totally. Besides the introduction (Chapter 1), in the proceeding chapters, there are not only the construction of theory but also the analysis of the practice according to Chinese situation.Chapter 2 introduces and elaborates the property right characteristics of the common-pool resources, the theoretical model of the allocation efficiency of the common-pool resources and the economic logic of the property rights-based management of the sea area usage and puts forwards the composition of the property rights of the sea area resources and the key issues of constructing the property rights-based management system of the sea area usage. It concludes that as far as the essence of the problem of the usage of the common-pool resources, the excludable, transferable, clearly defined and effectively performed property rights system should be set up to change the open access state of the common-pool resources.
