Study On The Legal System For Disaster Relief Of Military Medical Support Units

From a global perspective,the disaster public crisis is emerging."High-risk society"seriously affected the sustainable development of human society. China has entered the period of high risk of sudden disaster, showing a higher frequency, the increasing risk and more destructive trend. The army is increasingly involved in the work of disaster prevention and mitigation. As one important misssion of military operations other than war, involving in disaster relief has become a regular and practical mission of military medical support units. Although disaster relief in China is on the legal and standardized way, due to some limitations existing legal system hampered the rational use of the military medical service resources, making it difficult for military medical support units to function efficiently.This study considers the construction of the legal system for disaster relief of military medical support units as a composite process, aiming at exploring the legal support mechanism by analyzing the domestic and international legal bodies involved in disaster relief construction situation, learning the legislative experience of foreign armed forces, and integrating the local disaster relief laws so as to avoid the negative impacts of the delay of legislative practice for the military medical support units and make sure that the military medical support units play an important role in the disaster relief.In this study, discipline of management, law, medicine, psychology and sociology theories, the use of comparative analysis, documents analysis, field research, expert advice, induction, deduction, and case analysis methods are collectively used to analyze the necessity and feasibility of the legal system for military medical support units involved in disaster relief. The study aims to confirm the legal position, and explore the main path and basic content of establishing a complete legal system, and also the purpose, basis, model and principles of establishing the legal system. It also clearly illustrates the division of responsibilities, implementation principles, implementation procedures, logistics, preparation of emergency response plan, drill and other issues so as to establish and improve the existing laws and regulations. From the top-level macro-design height,it tries to design a set of scientific, rigorous, feasible and normative regulation to improve the country's existing emergency legal system and army disaster medical aid existing legal system,and then from the perspective of theory and practice, provide an useful path to facilitating the national disaster emergency management and completion of diverse military operations such as disaster relief.
