Of Medical Malpractice Third Party Mediation Mechanism Optimization Strategy Research

China is in the special historical period of social and medical system reform. Theincreased medical disputes and social problems showed during the processing reveal thesevere relationship between doctors and patients. The current solutions could not meet theneed of the growth of medical dispute.This dissertation systematically collects and sorts out the current publications homeand abroad to gain a good understanding of the status quo of the present study.Based on previous studies as well as questionnaires and expert interviews, it isintended to make a comprehensive survey of the operation of the third party mediationmechanism of the medical disputes in Chongqing and its influential factors throughanalyzing the characteristics, influential factors and solutions of medical disputes and thecauses of ineffective promotion of third party mediation mechanism in Chongqing.With the help of grounded theory, it analyzes the survey data, and makes an in-depthstudy of the medical dispute mediation processes constructed on the basis of system controlprinciple and System Dynamics. Drawing on the experience of other countries like theUnited States, Japan and German as well as Beijing and other cities like Tianjin andShanghai in their attempts to introduce non-litigation mechanism into medical disputemediation, it proposes an optimal solution of third-party mediation mechanism of themedical disputes in Chongqing, so as to solve medical disputes in a fast, effective andlow-cost manner and to establish a good doctor-patient relationship.The dissertation is generally divided into five parts:The first part: Preface. Describe the research background and the current situation ofthe paper. Make clear the purposes and meaning, confirmed the basic research methods andtechnique routes.The second part: Literature Review. Explore and analysis the related concepts, theoriesfoundation and the inner correlation in this study.The third part: To interpret the status of implementation of Chinese third partymediation mechanism and influence factor analysis based on the case analysis.The fourth part: The research of optimization strategy recommendations on thethird-party mediation mechanism of medical disputes in Chongqing. Patients and doctors from several hospitals were selected as the research target. Interview30hospital managers,medical stuffs from10hospitals, Chongqing Health Bureau and the District Health Bureau.Use grounded theory to analyze the data and get the relevant material such as influencingfactor and prevention interference of the third party mediation, and also make deep analysiswith the internal relations between them. In the end, the paper analysis the differences inthe process of medical disputes because of different behaviors, and the resulting impact toboth sides such as the patients and hospitals, the third-party mediation organizations,accreditation bodies, insurance companies when medical dispute occurred.The fifth part: Optimization strategy recommendations on the third party mediationmechanism of medical disputes in Chongqing.
